【摘要】 生产、销售伪劣产品罪在理论界一直存在诸多的争议,这些争议的存在,直接影响了本罪司法认定的统一,为了能够消除各种理论观点之间的冲突,笔者在坚持刑法客观主义所倡导的法益侵害说的基础上,围绕着生产、销售伪劣产品罪的客体、主观方面、客观方面、未遂形态等做了一些尝试性的研究。本文以法益这个核心概念贯穿于全文,充分发挥法益对犯罪构成要件要素、犯罪形态等方面的解释机能,得出:生产、销售伪劣产品罪侵害的客体为简单客体即产品的生产、销售管理秩序;主观方面只能是直接故意,获取非法利润目的为本罪主观超过性要素;“销售金额”是本罪的构成要件要素;本罪存在犯罪既、未遂形态之分。更多还原

【Abstract】 This essay primarily discusses following problems:the object,objective and subjective elements of such crimes,accomplished and unaccomplished of-fense,etc.The author believes that the object invaded by such crime is admini-strative order of product,the subjective aspect only is direct-intent,illegal profit-making purpose shoud be the constitutive elements of the crime, and the amounts of sells is an element of the crime.It exists a division between acco-mplished offense and unaccomplished offense.更多还原
