【摘要】 每一种新的传播技术的诞生都会给社会带来或大或小的变化,新技术通过改变传播从而改变世界。分众传播以其在传播主体、传播方式、传播内容、传播对象和传播效果上与大众传播的显著差别而显示出鲜明的特色。它秉承“自由自律”、“互动公开”等基本原则改变了传统大众传播“以传者为中心”的传播理念,通过广大分众传播者的积极参与,创造出“以受众为中心”的新传播观。在这一过程中,不仅传播内容得到空前的繁荣,而且传播者的传播权利有到了极大地扩展,传播能力也有飞速地提升。权利的实现离不开法律的保障,通过法律确立传播法律关系,以保障分众传播权利。作为一项最重要的分众传播权利——表达自由权,对该权利的司法保障是分众传播下司法公正的应有之义;此外,对于现行刑法行为理论对言论的可能侵害应当予以足够的警惕,只有站在宪政的立场上,对言论的性质作出合宪性的法律解释,突破传统刑法“言论=行为”的一元体系,这样才不至于使刑法理论背离宪政的目标。在分众传播时代,公民对司法公正的要求更为精致,这就要求司法公正能做到“传播公正”的要求,即让程序公正和实体公正能通过分众传播来展现给公众,从而实现每一个人对司法公正从内心的信仰,促使公正司法成为司法机关的常态运行方式。虽然传播公正的过程会由于传播者与法律人在立场上的不同而存在差别,虽然分众传播有侵蚀司法独立、影响公正判决、误导公众对法律认识的可能,但是分众传播与司法公正共同的目的、相同的信念、共同的使命以及对人权的尊重决定了分众传播与司法公正之间的互动必然是良性的、正面价值要远大于负面价值的。因此,分众传播一定是有利于公民树立法律意识、民主意识、法治观念,有利于传媒建立新的监督关系,有利于司法独立和协商型司法正义,有利于社会公正,从而最终有利于化解矛盾和实现社会正义的目标。更多还原
