【摘要】 大自然迫使人类加以解决的最大问题,就是建立一个在一定物质根基上普遍法治的公民社会,这已成为世界各国发展所认同的规律。因此人们关于法律现象的思想、观点、知识和心理即法律意识,在社会生活中扮演了极其重要的角色。不管是有意无意人们都要通过意象进入到法律的世界。在中国,“三农”问题是极大的问题,“三农”问题的本质就是“农民问题”,而农民的法律意识无疑在新农村建设乃至整个现代化建设中是至关重要的一个因素。因此对其进行法学层面的关注有着重大的理论价值和现实意义。本论文首先对新型农民法律意识的内涵进行剖析,通过对新型农民的界定,新型农民所处背景阐释,传统农民法律意识状态和法律意识“新型元素之体现”的对比,分析得出目前新型农民法律意识的特点是传统因素和现代因子的并存,而且这种并存的状态处于社会转型期这个大语境,也即传统社会向不同“质”的现代社会进行转变中产生的。论文第二部分从不同视角对新型农民法律意识的特点进行原因分析,因为正确把握事物的因果联系是自觉实践活动的必要条件,因此本文从市场经济对传统经济的冲击;传统文化与西方法治文明的冲突;民间法在农村法治建设中的的作用;农村法治理论研究的局限等四个方面进行了论证。第三部分探究了法律意识在整个社会转型、文化重建过程中的位置,把农民法律意识与社会发展及制度变革等方面联系起来,主要从新型农民法律意识培育的应然状态入手,阐述其法理基础,分别阐述了法律权威需要重新塑造,权利意识培育的方向重在精神生活条件和名誉方面,较新颖地把创新意识和幸福观引入到对新型农民法律意识的研究中,该部分还试图将中国文化情结与现代法治相对接,从而形成当代农民的法律信仰。第四部分论述了新型农民法律意识培育的现实路径,主要围绕与农民法律意识相关的外部因素来展开。从法的运行和作用着手,从立法层面、政府层面、司法层面和社会建设层面探索了新型农民法律意识培育的具体措施与方法。总之,新型农民法律意识的培育,不可能一蹴而就,它需要多方面的努力,包括农民自身在法治社会中的一系列活动、经验、感受之中而达到的对法的信任和依赖,包括农村的经济、政治、文化、社会建设,城市对农村的带动,工业对农业的反哺,包括政府对农民法律意识培育的有所作为等完善。因此新型农民法律意识培育的过程是一个具有长期性和渐进性的过程。更多还原

【Abstract】 The biggest problem that Mother Nature gives all the human beings is to build a civilized society with the common legal control and the foundation of materials. It also becomes the same idea recognized by the people all around the world. The legal consciousness plays a very important role in the social life. Nonetheless the conscious and the unconscious, the people must come into the world of law. In China, Three Dimensional Rural Issues is the most important problem, the nature of it is the problem of peasant, so the legal consciousness has an important effect on the new countryside construction even on the whole modernization no doubt.This thesis at first explains the content of the new type peasant’s legal consciousness, by analyzing, give the conclusion that the situation of legal consciousness of peasants is the coexistence of tradition and modernization. This kind of exist is in the period of the big social alternation. The second part of my thesis is reason analysis about the trait of legal consciousness with different views: the shocks of economic system’s reform, the conflict of traditional culture and the western law civilization, the effect of rural law and the shortcomings of the research on the rule of law in the countryside.The third part of this thesis, on the view of ideal situation of the new type peasants’ legal consciousness, narrate the foundation in the law theory, the different eyes are the dignity of the law, the right consciousness, the creation consciousness, the attitude towards happiness and the belief of the law. At last, my thesis put out the ways how to cultivate the new type peasants’ legal consciousness, mainly talk about the outside traits, divided into four parts: the legislation, the government, the judicature and the society construction.The modernization of the new type peasants’ legal consciousness can’t make an immediate point. It couldn’t like God created the world, "Let there be light and there was light." It is a kind of course in which the body and heart of peasants was involved into a series of social activity, experiences, feelings. The cultivate course is long-term and gradualness.更多还原
