地方政府决策的行政伦理规约研究

【摘要】 本文在对地方政府、地方政府决策的过程、地方政府决策者的伦理规约性等概念进行简要考察的基础上,对地方政府决策失误和地方政府决策的行政伦理规约行为进行了界定。随后分析了由于伦理失范导致的地方政府决策失误主要表现是:重自身利益轻公共利益、重局部利益轻全局利益、重近期利益轻长远利益。由此带来的五个方面的危害:导致社会财富流失、阻碍经济建设的进程、容易引发社会冲突、导致腐败现象蔓延和社会道德的沦丧、地方政府公信力下降。地方政府决策失误的伦理原因是多方面的。主要是地方政府决策者的价值观出现偏差,还有地方政府决策环境的外在影响,也有地方政府决策制度系统本身存在缺陷和弊端。本文重点研究地方政府决策主体的伦理价值观偏失造成的政府决策失误。最后,本文提出了从决策者价值理念角度规约地方政府决策,主要措施是:培养地方政府决策者的行政伦理自主性、通过教育培训重塑地方政府决策者的价值观、充分重视道德楷模的实践导向作用。另外,还要加强地方政府决策制度和体制系统方面的优化和完善。同时,要加强行政伦理立法的建设,在依法治国的大背景下,我国政府决策者的官德与作风建设走法治化之路是必然的选择。这种必然选择一是源于世界公共行政道德法制化的趋势与经验,二是源于当前中国官德与行政作风建设的实际情况。更多还原

【Abstract】 This text bases on the concepts,such as the course the local government,local government decision,the local government policymaker’s ethics stipulations,have defined the administrative ethics stipulations behaviors of local government and the decision fault of local government. Then,the research analyses the resons the resons about resulting local government decision fault.Such as valueing one′s own interests more than public interests,valueing local interest more than the interests of the whole,valueing interests of the near future more than the long-term interest.That will bring some dangerouse results:the loss of the wealth of society, hindering the process of economic construction,causing the social conflict,spreading the corruption and society′s ethical decay,descending the local government public trust.There are many aspects in Ethics reasons of the decision fault of local government.It is mainly that the values of the policymaker of local government present the deviation,and externality of the decision environment of local government,defect and drawback of a decision system of local government itself.This text mainly research the decision fault of local government,which is caused by deviation of ethics values of the key decision main body of local government.Finally,this text proposed that the local government of the stipulations makes policy in terms of policymaker′s value idea,the main measure is:Training the administrative ethics independence of the policymaker of local government,rebuilding the values of the policymaker of local government,fully paying attention to practice guide effect of the morals model.In addition,we should strengthen the optimization and perfection of the decision system of local government.Meanwhile,should strengthen the construction that administrative ethics legislate, under the great background of running the country according to law,it is the inevitable choice that officer of the policymaker of our government take the way to rule by law.One this kind of inevitable choice comes from trend and experience that the public administrative morals in the world legalize,second,come from the actual conditions of present Chinese officer Germany and administrative style construction.更多还原
