【摘要】 非刑罚化作为与非犯罪化并驾齐驱的当代刑法改革的主题之一。非刑罚化萌生于新社会防卫理论,是目的刑主义刑法思想对报应刑主义思想论战的产物。非刑罚化已经成为当今刑法发展的趋势。本文通过对中外非刑罚化的理念与制度上的深入研究,探究中国非刑罚化改革之路。笔者通过对非刑罚化的概念厘清,区分了非刑罚化与非犯罪化、轻刑化之间的界限。轻轻重重的刑事政策、犯罪学的实证研究作为非刑罚化的现实依据,非刑罚化的理论基础则是刑法谦抑性思想,对刑罚、刑罚权本质的反思。非刑罚化的途径主要有免刑制度、非刑罚刑事制裁措施、保安处分等具体制度措施。研究非刑罚处罚措施可有效地对刑罚的适用范围进行实质限制,同时可以解决劳动教养的法律定位等相关法律问题。根据以上理论,进而对我国非刑罚化改革进行理性思辨。探讨我国非刑罚化的可行性,然后具体研究在我国非刑罚化改革途径。中国非刑罚化改革要解决观念层面和制度层面上的困境,主要通过思想改革来转变传统刑法思想,通过建立多元化刑事处遇措施解决制度层面上的困境。更多还原

【Abstract】 Depenalization and Decriminalization are among the most important issues in modern Criminal Law reforms .Depenalizasion come from the new community defense theory, and it is the result of controversy between the intent penal theories and the retribution penal theories. Depenalization is a quite uniform trend in promoting the penalty system reform in modern western Countries.Through the study of the concept of depenalization system, the article explore the reform of Chinese depenalization. The author clarify the concept of depenalization in order to expain the distinction between depenalization and decriminalization, depenalization and light punishiment." Light Heavy" criminal policy and an Empirical Study of Criminology are the reality basement of depenalization. Theoretical basis of depenalization is Penal modest idea and the reflect on the nature of penalty and penal right. The realizing methods of Chinese depenalization includes:declaring offense simply depenalization sanction and security punishment. The study on depenal messures can restrict the scope of the application penalty,and at the same time it can sovle the re-education through labour and other related legal issues.Based on the above theory, the author study the further reform of Chinese depenalization rationally . Firstly discuss the feasibility of Chinese depenalization, and do research in the way of the Chinese depenalization reform. Through changing the traditional thinking of the Penal thinking to solve the concept of system level and at the level of difficulties; through the establishment of the variety solution measures to the criminal case to sovle problem of the system level.更多还原
