【摘要】 雇用他人从事生产经营活动是各国现代经济生活的必要。随着社会主义市场经济体制的确立,雇佣关系已经在我国社会生活中普遍存在。我国立法没有建立严格意义上的雇主责任制度,学界对雇主责任性质、构成要件以及责任承担的理解分歧较大。文章对雇主责任理论基础以及雇主的归责性进行辨析,分析了雇主责任与替代责任制度的责任形式、逻辑起点与价值追求,论证了雇主责任的性质属于替代责任。文章围绕雇主替代责任特征从认定雇主责任应该具备存在雇佣关系、雇员行为属于雇佣活动范围以及雇员行为应对第三人承担侵权责任三个构成要件入手,论证了雇主主观归责不应作为认定雇主责任的条件,并从内、外部责任承担与免责事由等方面对雇主替代责任的具体承担进行论述,在此基础上建议现阶段我国司法实践对于雇主责任应侧重于责任构成要件的理解,从而更准确地把握雇主责任的认定,并对于如何完善我国雇主替代责任制度提出初步构想。更多还原

【Abstract】 It is necessity that employs the others to produce to conduct the activity is modern economy in all countries. Along with the establishment of the socialism market economy system, employment relationship activities already widespread existence in our country. The system of liability of employer has not been built up in our country in the strict meaning, so that the comprehension rift of academia circles to it compare greatly. The article differentiated and analyzed the theories foundation of the liability and the subjective imputation of employer, and analyzed the modality of liability ,the beginning form of logic and the pursuer of value of the liability of employer and the substitute duty, demonstrated that the property of the liability of employer belongs to the substitute duty. The composing of the liability of employer comprise the employment relationship, employment and the duty of employee, base on it we can know that the subjective imputation of employer is not the composing of the liability of employer. On the base of the demonstration of inner and external commitment, and the cause of exempt liability, the article demonstrated the specific commitment of the liability of employer. On all accounts, the suggestion is that at present stage we should lay particular emphasis on the composing of the liability of employer, so that we can hold it more accurately. At last, the article put forward the brainchild for how to perfect the system of liability of employer in our country.更多还原
