独立学院产权明晰与流通制度研究

【摘要】 自1999年第三次全国教育工作会议召开之后,为扩大招生规模,在满足社会需要的同时拓宽学校收入来源渠道,江苏、浙江两省的部分普通高校相继进行了举办民办二级学院的尝试。此类办学后来在广东、辽宁、山东等省份也相继出现,引起社会的广泛关注。2003年4月教育部颁发了《关于规范并加强普通高校以新的机制和模式试办独立学院管理的若干意见》,正式将这种新型办学模式定名为独立学院。独立学院是我国教育制度创新的产物,是我国高等教育大众化背景下,为解决旺盛的高等教育需求与有限的优质高等教育资源供给间的矛盾而产生的。由于独立学院本身的特殊性,自产生之日起就伴随着诸多问题与争论。这些问题与争论涉及到了独立学院的发展方向、办学模式、管理体制、人才培养等等方面,其中多数问题是由其产权制度的缺失引起的。因此,对独立学院的产权制度进行深入系统地研究对丰富教育产权理论以及指导独立学院的教育实践均具有积极意义。本文从独立学院的办学特性、办学类型入手,分析了独立学院产权关系现状及存在的问题。在对产权、产权制度、教育产权、学校法人财产权等概念进行界定的基础上,提出了引入产权经济学相关理论对独立学院的产权关系与产权制度功能进行分析。在阐述了独立学院产权关系的相关利益分析之后,论证了独立学院产权明晰与产权流通的必要性,并在此基础上提出了独立学院产权明晰与产权流通的制度设计以及产权视角下独立学院内部治理结构完善的相关内容。本文的研究特色在于:①系统地采用了产权经济学的相关理论对独立学院产权关系中存在的问题及解决方式进行了研究。②利用比较研究,借鉴民办高校产权理论研究成果,具体建立了独立学院的产权明晰与产权流动模式。更多还原

【Abstract】 Since the third China educational meeting held in 1999, in order to expand admission scale and broaden sources of revenue channels, some higher institutions in zhejiang and jiangsu province have tried to establish secondary colleges. Later this new institution pattern came into being in guangdong, liaoning, shandong province, which aroused widespread social concern. In april 2003, the ministry of education issued“suggestions on regulating and strengthening higher institutions to establish independent institutions”,in which the new institutition opattern officially is named independent institutions.The independent institution is the product of China educational system innovation. And also it appears for resolving the contradictions between strong demand for higher education and limited excellent higher education resources on the background of the higher education popularization. Because of the perticuality in itself, independent institutions has many problems and controversies from its establishing. All of these problems and controversies concern the independent institutions’development trend, the institution patterns, management system and personnel cultivation, most of which are caused by lacking for property right system of independent institutions. Therefore, deeply and systematically research on property right system of independent institutions has positive significance in enriching educational property theory and practical development of independent institutions.Starting from the features and categories, the paper analyzes the present situation and some problems of independent institutions’property right relations. Based on the definitions of property right, property right system, educational property right, and the property right of artificial person, the paper applies some theories about property economics to analyze property right relations and property right system function of independent institutions. And then, the paper expounds the relevant interest of independent institutions’property right, and discusses the necessities of the clarity and flow of property right. On the basis above, the paper puts forward the system design of clarity and flow of property right, and discusses the inner administration of independent institutions in the perspective of property right.The paper’s innovation points lie in:①systematically apply theories about property economics to research the problms and sulutions in independent institutions’relations;②apply comparative study and refer to the research achievements about private higher instutions’property right to eatablish the patterns of clarity and flow of property right.更多还原
