【摘要】 社会经济转型期间,各种市场主体纷呈涌现。物流经营人作为一种新型的市场主体,在经济生活中发挥越来越重要的角色。然而,在我国的具体实践中,形成了自己的特色,比如货运代理人和无船公共承运人他们承担了物流经营人的部分责任,已经成为物流经营人重要的组成部分,因此,在我国物流经营人的主体应该包括具有实践意义的国际货运代理人以及无船公共承运人。然而在处理相关法律纠纷时,主体的多样性常常带来不可避免的市场困惑,本文通过对典型案例的分析,阐明复杂的物流经营人的主体法律地位。本文主体分四个部分:第一部分:物流经营人概述。将物流经营人定义的狭义及广义两层含义做区分。第二部分:狭义物流经营人的主体法律地位。从典型案例入手,以例为证,得出狭义物流经营人的主体法律地位。第三部分:国际货运代理人作为物流经营人时的主体法律地位。从国际货运代理人的定义以及发展趋势入手,从而近观中国具体实践,通过典型案例的分析,透析国际货运代理人充当物理经营人的真实法律地位。第四部分:无船公共承运人作为物流经营人时的主体法律地位。仍然通过对典型案例的分析,确定无船公共承运人充当物流经营人时的主体法律地位。更多还原

【Abstract】 During the dramatic change of the social economy, many new market participants mushroomed. Logistics mangers make a new function in the economy development. However, on the basis of late start and low level development, many logistics service only stay on the basic level. With the great tendency of logistics service has becoming an industry, many traditional factories changed themselves superficially to so-called logistics managers, such as freight agent venture, etc. This phenomenon makes the logistics service market more complicated and less organized. Among this, two practices have been taken the most concern. The freight agent venture and the NVOCC serve as logistics managers, which make the market obscure both in the normal market order and especially in the legal discipline.This paper contains four parts: The first part: The general presentation of the outline of the logistics manager.The second part: To analyze the legal status of the subject of the international freight agent when it serves as a logistics manager.The first step was to clarify the main tendency of the international freight agency, and get a close look of China’s practice in this industry. According to the analysis of the typical cases, I got a final answer to the real legal status of the subject of the international freight agent when it serves as a logistics manager.The third part: To analyze the legal status of the subject of the the NVOCC when it serves as a logistics manager.The forth part: The real legal status of the subject of the logistics manager.After thorough study of the legal science, the answer to the paper will come out. The real legal status of the subject of the logistics manager is commissioner.Consideration is on the careful review of China’s practice.
