【摘要】 考察各主要国家之立法,均将精神状况良好之成年人身自由受限制者视为完全行为能力人,允许其享有独立从事各项民事活动之权利。但是实际上,由于人身自由受限制,与外界的交流和联系受到严格限制,导致人身自由受限制者无法像处于正常的自由状态时那样及时、便捷、完全地了解和获取进行民事活动所需的各种信息,对人事的分析、判断、辨识能力必然大打折扣,其所作出的意思表示也必然存在瑕疵,由此决定了其行为能力的不完全性。若允许人身自由受限制者独立从事民事活动,极可能会给其本人以及其他利害关系人造成不利益,在实践中带来一系列问题。因此,人身自由受限制者应当被确认为限制行为能力人,这既是基于理论上的推导,又是基于实践的考察,更是创新和完善民法体系的需要。人身自由受限制者确认为限制行为能力人之后,应当进一步考虑如何具体设计人身自由受限制者行为能力体系之立法,这一点具有重要意义,而立法设计的重点应放在人身自由受限制者行为能力类型化及其标准、行为能力认定的相关机制、行为能力范围、行为能力补正和补正中的救济等方面。更多还原

【Abstract】 Review lawmaking of main nations, all of which has regarded people whose personal freedom are limited as complete capacity person and allow them enjoy the rights to engaging in all kinds of civil activities independently. However, in fact,because of being restricted, communication with the outside world of people whose personal freedom are limited is broken,which makes them can’t gain any information on civil activities in which he wants to engage timely, conveniently, directly and completely. Thus his ability to analyse, estimate,discern men or things will be affected,that means his civil capacity is imperfect.If allow them engage in all kinds of civil activities independently,it is likely to encroach on interests of people whose personal freedom are limited themselves and other interested people,besides, bring a series of problems. Therefore, it’s necessary to declare people whose personal freedom are limited of the person limited in civil capacity, which is not only based on theory deduction and investigation on practice, but also the demand for innovating and perfecting the Civil Law system. Assuming that people whose personal freedom are limited have been established as person limited in civil capacity,we should further consider how to concretely design the legislative of civil capacity system of people whose personal freedom are limited,which is of significant.The focal point of legislative should be something involving people whose personal freedom are limited such as the categorization and the criterion of capacity, establishing mechanism of civil capacity, range of civil capacity,revision of civil capacity and relief for the revision and so on.更多还原
