【摘要】 雨水利用是一项被广泛应用的传统技术,曾有力地促进了世界上许多地方古代文明的发展。现今,国内外对于雨水集蓄技术的普及和应用已越来越广泛。在我国的干旱半干旱地区,水资源匮乏,区域性、季节性干旱缺水问题严重又不利于修建骨干水利工程,若要改变这些地区的贫困落后面貌,大力发展小、微型雨水集蓄工程,发展节水灌溉是这些地区农业经济发展的唯一出路,实践证明,这项措施投资小、见效快,便于管理,应得到大力推广和全面普及。然而,由于雨水集蓄工程的修建具有一定的地域性特点,必须和自然条件及生产生活相结合,工程的选址经常要受到一定客观条件的限制,且由于雨水集蓄工程的修建主体、资金来源以及社会影响力的不同,使得在法律上明确雨水聚集工程、工程用地的产权关系越来越具有现实性和重要意义。本文试从物权角度研究在雨水集蓄过程中的集蓄工程和工程建设用地所产生的相邻关系,以工程及其用地的产权归属来具体划分相邻关系,以物的性质和物的归属为标准,对相邻关系的主体、客体和内容分别作了探析;其中创造性地提出了在雨水集蓄过程中应分为集蓄工程及其工程建设用地两类相邻关系的主张,并从法律性质与激励机制两方面进行综合考量;其次,对雨水集蓄过程中相邻关系制度进行了延伸性的思考,探析了相邻关系的法律原则及其道德特性,认为在经济欠发达地区,雨水集蓄的相邻关系体现出具有特色的道德需求,在处理因相邻关系所出现的纠纷和问题的时候,不能一刀切和等量齐观,应依据不同的情况,确定不同的处理方式。道德所具有的区域性和传承性在此可以发挥其应有的作用,而法律也可以对道德加以提炼和抽象化,使其更加符合具体的情况。最后,本文试进行了雨水集蓄中相邻关系致害的法律经济分析,并进一步探讨了公法相邻关系。更多还原
