【摘要】 本文主要介绍国民党政府定都南京后在市政建设过程中进行征地时的补偿情况。南京市政府为了维护首都的稳定,先后制定了一系列关于土地征收的单行法规,并且针对征地过程中出现的问题又采取了相应的补救措施,形成了比较完整的土地征收政策。这不仅保证了政府征地工作的顺利开展,也基本上维护了社会的安定。因此,南京市的征地补偿政策具有一定的典型性和代表性。通过对南京市的征地进行研究,既可以总结归纳出民国时期土地征收以及补偿的实际情况,又可以为今天土地征收问题及补偿问题提供借鉴意义,为现代城市解决土地问题提供参考经验。本文重点是对征地时的地价及定着物的补偿情况进行了进行研究和探讨。征收土地是一种法律行为,其所需要的是土地的支配权的转移。在保护私有财产不受侵害的情况下,对于征收土地的补偿应当以完全和充分为原则。而地价及定着物正是土地价值的主要组成部分,所以从这两方面进行探讨可以抓住征地补偿的本质。这两个方面也正是今天征地制度的两个重要难题。在论述具体的征地补偿办法之前,本文先简略的介绍了南京市土地征收补偿的依据和补偿的范围,以期在具体的历史环境中进行研究。在文章的最后又对南京市的征地补偿政策作了进一步的分析,认为南京市征地工作之所以能够顺利进行也与南京的城市特点有关。这也是我们当今征地政策中应当注意的问题。更多还原

【Abstract】 The thesis gives a brief introduction to the compensation of land takeover for public use in municipal facility construction after the national government moved the capital to Nanjing. The government of Nanjing city had drawn up a series of single regulations on land takeover and taken corresponding remedial measures to eliminate the problem in the process of land takeover and safeguard the stability of the capital, and formed a relatively complete land takeover policy. It not only ensured that the work of land takeover went through well, but also maintained social stability. Therefore, the policy of land takeover compensation in Nanjing is typical and representative of this kind. The research will not only summarize the actual situation of land takeover and compensation during the republic period, but also provide reference for the problems of today’s land takeover and land using in modern urban city.The focus of the thesis is the study on the compensation of land price and fixtures when land takeover for public using occurs. Land takeover is a legal action and it is necessary to transfer the ownership of land. The compensation for land takeover should be based on the principle of completeness and fullness to protect private property frombeing aggrieved. Nevertheless, land price and fixtures were the main components of thevalue of land, so it can grasp the essence of land takeover from these two aspects. These two aspects were precisely two important problems of today’s land takeover system.Before the discussion about the specific methods of land takeover compensation, the paper briefly introduced the basis and scope of it in Nanjing city so as to study this problem in the specific historical environment. Finally, the thesis made a further analysis on the policy of land takeover compensation in Nanjing, and deemed that the work of land takeover went through well may be connected with characteristics of the city of Nanjing.
