【摘要】 城市规划是一个动态的过程,与城市经济、社会、文化有着直接的联系。一直以来,城市规划中的利益主体为寻求自身利益最大化,试图将城市规划行为作为自我利益满足的工具和手段。城市的发展对城市规划工作的方方面面提出迫切的要求,城市规划对城市发展起着反作用,规划过程中引发的争端不仅成为诸多社会问题的根源,而且成为城市历史沿袭和城市发展进程的障碍。城市规划中的利益主体之间的关系倍受人们的关注,规划的实际效用因此受到各学科、各领域的质疑。城市因资源的集聚而成为诸多利益主体为谋求自身利益最大化而博弈的战场,同时也成为各学科研究的焦点。有矛盾必然会有统一,那么,如何解答、解决矛盾和质疑,维护公共利益,使城市规划成为实际意义上的城市预测,成为研究的重心,更是研究的宗旨。本文通过对我国城市规划中的利益主体因利益争夺而引发的矛盾起因、过程及平衡机制的论述,指出法制体系的建设与完善的市场机制对我国城市规划的影响重大.针对我国旧城改造规划中所出现的弊端,同理论述法制体系的建设与市场经济体制的完善对于旧城改造规划的顺利实施同样具有重大意义。因此,提出构建法制社会、增强居民法制观念,对于规划过程的参与与监督,以及完善的市场机制,是确保规划方案成功实施的关键。更多还原

【Abstract】 Urban planning is a dynamic process, and urban economic, social and cultural have a direct link. All the time, stakeholders seek to maximize their own interests, and trying to meet of self-interests as tools and means by actions of urban planning. The urban development in all aspects of urban planning made an urgent request. Urban planning plays a counterproductive for urban development, the planning process has triggered by the dispute have not only become the root cause of many social problems, but also a city of history and urban development process followed the obstacles.People pay more attention to the relationship between stakeholders in the urban planning, and then the effectiveness of planning has been questioned by and various fields. City has become the battlefield of Game on the basis of the accumulative of resources and a lot of stakeholders to pursue their own maximize interests, at the same time has become the focus of the multidisciplinary study. There are contradictions will be a unified, then, how to answer and solve contradictions and questioned, in the public interest, made the urban planning in real sense of the city forecast, become the focus of research, even more the aims of the study.By the description of China’s urban planning in the stakeholders of the contradiction of the arising for the cause, the process and balance mechanism because of the interest struggles, point out legal system construction and improvement of the market mechanism is significant impact in the China’s urban planning, aimed to appear the abuse in the transformation of old city planning in our country. Similarly the legal system construction and improvement of the market mechanism is the same significant impact to ensure the smooth implementation in the old city construction planning.
