【摘要】 我国现行的江河流域管理制度弊端很多,立法滞后、体制不顺以及江河流域水资源污染严重等问题已很不适应社会主义市场经济发展的客观需要,及时构建和谐的环境法律体系已成为共识,然而如何构建适应我国目前社会和谐发展需要的法律体系,目前还是值得研究的问题。本文将该领域立法方面存在的问题概括如下:我国现行的流域管理立法在立法权的配置、法律规定的内容、法律运行的实效等方面存在诸多缺陷,如流域管理立法进程严重滞后,主要涉水法律之间的关系不清、严重失序,规范性法律文件之间相互冲突等。本论文研究从我国流域管理的历史和现状入手,剖析了流域管理存在的问题,借鉴了国外流域管理的先进经验;以流域管理的行政、法律地位为核心问题,研究阐述了制定江河流域立法的必要性、可行性;力图以新世纪发展的眼光,站在国家管理资源的高度,论述流域管理原则、管理体制、主要任务及基本法律制度。因此,借助本研究,为流域保护法律法规的建立和健全提供帮助。全文一共分为五章:第一章:导论。主要阐述了论文研究的目的和意义、综述了国内外有关流域环境法律体系的构建状况;详细阐述了该论文主要试图从三个方面来构建和谐的流域环境法律体系,并阐述了研究的方法和研究思路。第二章:流域环境管理基本法律理论。本章首先从流域环境管理基本概念---流域的含义入手,进一步解释研究了流域管理的含义,流域管理的目的,流域管理制度的理论基础,流域管理立法的原则。第三章:国外流域环境管理法律体系研究。本章分别研究了美国、英国、法国、日本和澳大利亚等国家的流域管理立法,并由此得出对我国流域管理立法的启示。第四章:中国流域环境法律现状剖析。本章首先对我国现阶段的流域环境立法的现状进行了分析,并详细阐述了我国流域环境法管理体制中存在的问题,第五章:中国流域环境管理法律体系的构建与完善。本章对我国流域环境法律管理法律体系的完善提出了一些建议,主要是从法律方面、环境管理执法体制度等进行了阐述。希望通过本文的研究,在我国颁布实施新水法的基础上,能够进一步完善流域管理法制化建设,制定行之有效的流域管理基本制度,明确流域治理开发的总方向、目标和各种措施,确定流域管理机构的权力、责任、义务和流域管理体系中的管理地位,全面解决公民参与流域管理中存在的障碍,以此作为处理流域管理中重大问题和协调各种利益矛盾关系的主要法律依据,来实现流域管理的可持续发展。更多还原

【Abstract】 There are many shortcomings in current river-basin-management system in effect in our country, for example, legislation lagging, obstacles in current system and serious pollution of river basin water resource and so on, which can not adapt to the development of a socialist market conomy objective need. Structure harmonious environmental statutory framework in time already becoming a common view, but how to build a legal system that the harmonious development of our society which will adapt to our country’s needs at present, all that still is a problem which worthy studying at present. There exists a lot of defects in the legislation managemnent of river basin of our country in effect at present. In this paper I summarized all the problems of legislation in river basin system as follows: the legislation allocation in legislative power, the content of legal rules, working actual effect of law, for example the grave lag of manage course of the river basin legislation, the ambiguity and the disorder of the laws about water, and the mutua lconflict between norm law document. The thesis has studied history and current situation that the river basin manages from our country starting, has analysed a river basin managing have problem, has drawn the advanced experience that the river basin manages abroad.Problem centering on administration, legal status that the river basin manages, research has been set forth working out rivers river basin legislation necessity, feasibility; The sight striving to develop with new century, station the legal system discussing a river basin highly, managing principle, managing system, major task and basic managing resource in the country. Therefore, draw support from the building-up studying originally , protecting for the river basin laws and statutes’s and perfect providing help. There are five chapters in this paper:Chapter 1: The document is summed up. Have set forth purpose and significance that the thesis studies mainly, have summed up home and abroad structure about river basin environmental statutory framework building status; Have set forth method and the train of thought studying being a thesis’s turn to study having tried to structure harmonious river basin environmental statutory framework from about three aspect, and having expounded mainly detailedly. Chapter 2: Fundamental law of river basin environmental management theory. Seal manages basic concept——river basin import first from river basin environment starting, explain the purpose having studied the import, river basin that the river basin manages are administrative further, the river basin manages the system rationale, the river basin manages the legislation principle.Chapter 3: River basin environmental management legal system studies abroad. And legislation chapter country’s river basins such as USA, United Kingdom, France, Japan and Aussie having studied respectively is managed, reach from this to our country river basin administration legislation enlightenment.Chapter 4: Chinese river basin environment law current situation analyses. Seal has carried out analysis on our country present stage river basin environmental legislation current situation first, has set forth and our country river basin environment law management system middle have problem.Chapter 5: River basin environmental management legal system structure founds and perfects Chinese. Seal manages a legal system improving and perfecting to our country river basin environment law having submitted a little suggestion, is environmental management mainly from legal aspect, enforce the law experiencing and observing system waiting to have been in progress expounding.Based on my research and the new water-law, I hope that there can be able to perfect a river basin further managing institutionalize construction, work out the effective river basin managing fundamental system, make clear that the river basin governs development general direction, target and various measure, ascertain administration position in river basin administration authority, responsibility, duty and river basin administrative system on new Water Law of our country promulgation and enforcement basis, the overall settlement citizen participates in a river basin managing the obstacle there existing in middle, is the main contradiction relation law basis handling a river basin managing middle major issue and harmonizing various benefit on this account, Come to realize the sustainable development of the river basin management.更多还原
