【摘要】 《土地管理法》第十九条明确规定我国编制的土地利用总体规划应严格保护基本农田,控制非农业建设占用农用地;提高土地利用效率;统筹安排各类、各区域用地。在国发[2004]28号文件和[2006]31号文件中都相继明确了土地利用总体规划在调控土地中的重要作用。因此土地利用规划是国家宏观调控的重要手段,在目前城市化进程加快,城市用地矛盾突出的情况下,应充分重视并有效利用土地利用规划。随着我国国民经济持续快速增长,城市规模不断膨胀、城市人口不断增加和各种资源向城市的大量聚集,城市土地开发利用的广度和深度逐渐拓宽,致使大量城市近郊区的农用地被占用,城市体系的布局结构不合理,城市土地利用效率低,城市环境问题日益严重等情况凸现。这些问题不仅制约了土地资源最优配置的实现,而且影响到整个社会经济的可持续发展的实现。土地利用规划肩负着进行土地资源优化配置,实现土地资源可持续利用的重任,无论是政策法律、规划理论、还是城市发展的客观要求都需要土地利用规划发挥其综合协调、控制与引导的作用对城市土地进行调控,解决城市扩张中存在的一些土地问题,以达到平衡“吃饭”与“建设”的土地需求,促进城市土地的合理集约利用,最终实现城市以及整个社会的经济、社会、生态效益的最大化。由于土地利用规划在调控城市土地过程中存在一些因素影响致使规划缺失,没有有效发挥其应有作用,而社会的发展又不断为土地利用规划提出新的要求,使土地利用规划迫切需要通过一些方法和措施来逐步完善自身体系及相关保障体系。本研究在目前城市发展中存在的土地问题以及其突显的土地利用规划作用缺失的基础上,分析土地利用规划失效的原因和城市发展对规划的新要求,并通过实证研究分析了土地利用规划失效的表现,最后为土地利用规划能更有效的调控城市土地提出了一些措施和建议,以使规划能更好发挥其作用。全文研究内容共分八章,主要包括:第一章为绪论,介绍研究的背景、意义、研究的主要内容和目标、理论基础、研究方法和研究的技术路线。第二章介绍土地利用规划对城市土地的发展概况,及规划对城市土地的调控依据、手段和土地利用规划对城市土地调控作用。第三章概述城市发展和发展中存在的城市土地问题,分析这些问题表现的土地利用规划在调控中的缺失。第四章分析土地利用规划失效原因,包括引致规划失效的内部原因和外部原因。第五章阐述城市发展对土地利用规划的新要求。第六章对浙江省土地利用总体规划的实施评价,得出该规划在对城市规模控制、耕地保护、城市土地集约利用等方面的失效并简要分析失效原因。第七章从土地利用规划失效的内、外部原因,分别提出对规划进行改进的措施和建议。第八章对本文总结性概括,并得出研究结论。经过研究表明,由于城市发展中出现的土地问题的复杂性,以及土地利用规划本身的局限性,在这种内、外部因素的作用下,土地利用规划在实际操作中可能存在失效,所以,针对规划失效的内部原因,应主要从完善规划编制、加强土地利用规划与相关部门规划的合作,完善法律监督体系以及扩大规划宣传力度等方面进行改进,而针对规划失效的外部原因,虽然尚未有切实有效方法,但也可以通过规划理论、经验的不断借鉴积累以及动态检测等手段来改善。更多还原

【Abstract】 The Law of Land Administration of the People’s Republic of China offers that.strictly protect the basic farmland and control the occupation of agricultural land for nonagricultural purposes;raise the utilization rate of land;make an overall plan and arrangements about the use of land in various kinds and various areas.The congress’ policy in files of 28^thand 31^thhas also enhanced the significance of land planning in adjusting and controlling land.So land planning is a useful method for givernment to carry out its macroscopic controlling.At preasent,with the contradiction of urban land using,it is essential to pay more attention to the function of land planning.With the rapid and continous development of our country’s economy,the cities have expanded to a large scale,and the exploitment and utilization of urban land have increased to a high degree also,no matter depth or width.Because of those,there are many problems appearing aboat land use in urban,such as,the decreasing sharply of rural land,the low efficiency of urban land,and unproper arrangment of urban land, and so on.All of the problems not only constrain the optimum distribution of land,but also influence the sustainable development of the whole society.Land planning is an important method tu distribute land resource properly,and use land sustanably,which is provided in laws and some theories.What’s more,the development of urban also need land planning to adjust and control land use,resolving land problems in urban expand to make balance of land use between eating and building,and at last to make the whole society to get the optimum effiency in economy,society,and enviroment. Because of some factors that land planning lose efficacy in certain areas during the process of adjusting and controlling the urban land,in addition of new demands that the changing society provide to land planning,it needs some effect methods to improve. On the base of land questions in urban development and the difficulties of land planning in adjusting and controlling the urban land,the paper analies the causes of land planning losing efficacy,and through a case of Zhejiang provence,it analies the displays of land planning’s cease to be effective.At last,in order to making land planning works more eddective,this paper provides some improve ways.The whole article divides into 8 sections to explore the topic,as follows:The first part,the exordium of the paper,introduced the background,purpose, significance,ralative theories,object content,and skill routs.The second part,introduced the general development situation of land planning and urban land using,the foundation that land planning according to adjust and control the urban land,and express the affect that land planning towords urban land.The third part,elaboratd all kinds of land questions existing in urban development, according to which probing the uneffect display of land planning in adjusting and controlling urban land.The fourth part,analysed the causes that make land planning lose efficacy,those include inner causes and external causes.The fifth part,elaborated the new demands towords land planning with the development of urban.The sixth part,provided Zhejiang provience as an example,evaluated the result of its land planning,and found the planning uneffective in controlling urban scale, prtecting farm land,and using land more efficience.The seventh part,provided some useful methods to resolve questions that land planning meeting in practise.The eighth part,the conclusion of the whole paper.According to the research,because of the complicate questions in land using during the development of cities and the shoutmeet of land planning,which as the external and inner causes.Under these factors,land planning lose its effecicy in practise.We should resolve inner these questions by improving the planning itself in formulating,and enhancing the cooperation between land planning and other relative plannings or departments,compliment the laws and monitor systoms,and also enhancing the propaganda of the idea of land planning to the public.As to the external causes,there is no effective methods recently,but we could through stimulate the experience and monitor the practise of land planning to change the situstion.Wahtever, we should make land planning play more important role in adjusting and controlling of the urban land.更多还原
