【摘要】 在我国加速城市化建设的进程中,新建商品房居民区在居民住宅中所占的比例越来越高。由于新建商品房居民区居民的较高文化程度决定了他们广阔的眼界;较高的经济地位决定了他们更少依赖于政府而生存;较高的物业价值决定了他们会极力保护自身的利益;较高的生活质量决定了他们追求更高层次的精神需求,因此,他们极力要求居民区自治程度得到进一步提升。然而,从目前居民区自治模式来看,在较高层面仍没有一套完全适应新建商品房居民区管理需求的规范出台,或者说还没有与新建商品房居民区开展自治完全匹配的法律体系;在基层又没有更多地从人文关怀等角度设计或总结一套新建商品房居民区开展自治工作的方法和经验,而如果政府在新建商品房居民区继续以帮困送温暖为工作重点,居委会继续以街道办事处的“派出机构”的面目开展工作,那在业主心目中,由业主自发组建的业主委员会的地位可能会逐步高于居委会,我们的社会控制力可能会降低。本文通过对我国居民区自治建设从1949年的自治起步初创,到1958年开始的因“大跃进”和“文化大革命”而逐步产生自治脱轨,到1978年拨乱反正后开始的自治回归的历程回顾,勾勒了新中国成立后社区管理由“受尽欺凌的家庭人→有序呆板的单位人→自由规范的社区人”这一过程,阐明了居民区自治是社会发展的必然,也体现了自治过程是因时代、因条件而曲折变化、波浪前进的过程。然后,本文提出了我国的新建商品房居民区由于存在自治主体不同、自治主体的自治能力更强、自治主体的需求更高、对政府的依赖性更低、对社区的归属感更强等5种不同于传统居民区的特点,因而亟须开展新建商品房居民区自治管理方式的探索,点明了开展新建商品房居民区自治建设研究的重要性和迫切性。通过着重对上海市黄浦区、武汉市百步亭社区近年来在开展新建商品房居民区自治建设方面探索的经验介绍,以及借鉴国外西方国家在开展居民区自治建设方式上的成功模式,提出了我国在开展新建商品房居民区自治建设方面的六条建议:树立居民区党组织在居民区中的主导地位、因人而异培育居民区成员主体意识、创新完善自治开展的条件、提高各方服务意识、发展非政府组织。更多还原

【Abstract】 In the course of accelerating city construction in today’s China, the proportion of the new commercial housing community is getting higher and higher. Since the residents in the new commercial housing community, have higher level of education which decided their vast field of vision; the higher economic status decided them being dependent on the government still less but has existed; The high property value decided they will protect own benefit vigorously; the high quality of life had decided they pursue the top level energetic demand, therefore, they request the inhabited area autonomous degree to obtain further promotion vigorously..However, the residential area of autonomy from the current model, in the high stratification plane still did not have a set to adapt the new commercial housing community management demand standard releasing completely, or also not legal framework releasing which autonomous matches completely with the new commercial housing community development; In the basic unit also does not have more from angle designs and so on humanities concern or summarizes a set of the new commercial housing community development autonomous work method and the experience, but if in the upscale inhabited area, the government continues take to experience hardship delivers warm as the key emphasis in work, the residents’ committee continues by the sub district office“the Agency”appearance development work, then in the minds of the owners, sets up spontaneously by the owner the owner committee’s status will possibly be higher than the residents’ committee, our social controlling force will possibly reduce.This thesis showed us the lack of the new commercial housing community’s autonomy’s management model, from 1949, and carry out construction in the new commercial housing community’s autonomy on the importance and urgency, based on that recalling that China’s construction history of the community’s autonomy, to show us the necessity being that having expounded the residential district autonomous rule is social development, has also embodied be condition because of times , because of but circuitous autonomous rule process change , and the winding advance process.
