【摘要】 随着城市发展及城镇化进程的加快,城市房屋拆迁纠纷逐渐成为社会性问题。目前我国对城市拆迁行为的性质还没有形成统一的认识,关于城市拆迁补偿的内容也只有一些原则性的规定,没有形成一套完善的城市拆迁补偿制度。本文结合目前我国城市房屋拆迁的政策现状,为构建完善的城市拆迁行政补偿制度作一些理论上的分析和思考,以求从制度上保证社会公共利益,也为我国城市化建设拆迁中面临的实际问题提供一些新的思路和参考。本文采用美国学者威廉·N·邓恩的“以问题为中心”的政策分析模型,对我国房屋拆迁补偿制度进行分析。全文共由七部分组成:导论部分主要就近期发生的拆迁补偿中出现的问题结合新《城市房屋拆迁管理条例》的相关规定,引出要最大限度地维护被拆迁人的合法权益,就必须完善现行的城市拆迁行政补偿制度。然后第一部分是对相关概念的界定及分析方法的阐述。第二部分对政策问题进行构建,论述目前我国城市拆迁行为总体上是一种公益行政征收行为,建立政策分析的中心问题,为政策建议提供一个分析范畴。第三部分对我国建国以来的城市房屋拆迁政策进行梳理,找出政策存在的问题与不足。第四部分结合房屋拆迁行政补偿制度面临的政策环境,从而引出完善我国房屋拆迁行政补偿制度的发展方向。第五部分是进行理论分析与探讨。第六部分提出完善城市房屋拆迁补偿的政策建议。最后结束语部分进行了总结和展望。更多还原

【Abstract】 With urban development and the process of urbanization speeding up, Urban Housing Demolition dispute has been gradually becomes a social problem. However, at present, China’s urban demolition of the nature of the act has not yet formed a unified understanding. On urban demolition compensation there are only some of the contents of the provisions of principle. With the different standards throughout the country, a perfect urban demolition compensation system hasn’t form.In this paper, with the Chinese urban housing demolition policy status quo, I am tried to build of the perfect urban demolition compensation system for a theoretical analysis and reflection. From the system in order to promote social and public interests, for the building of China’s urbanization in the practical problems facing some new ideas and information.In this paper, I use the American scholar William·N·Dunn "to the problem as the center of policy analysis" model, the demolition of housing and the development of the changes for analysis. The full text of a total for seven parts: Introduction mainly on the part of the recent demolition of the problems of compensation in the light of the new "Urban Housing Demolition Management Ordinance" of the relevant provisions of its unreasonable, led to the demolition was the maximum maintenance the legitimate rights and interests, we must improve the current system of the urban demolition compensation system.
