【摘要】 保姆人身权利受到侵害问题,目前新闻媒体关注比较多,特别是最近几年,新闻报道中涉及保姆人身权利受到侵害的问题更是频繁。本文分为四章,第一章是保姆现状分析,从保姆存在合理性以及对保姆的分类着手,并对目前保姆市场中存在的不正常现象进行分析。第二章分析保姆市场中各权利主体之间的法律关系,主要着眼于保姆,家政服务公司和雇主三方面,分析它们三者之间的法律关系。笔者对雇佣关系和家政服务合同法律关系进行比较,认为保姆和雇主之间是家政服务合同法律关系。由于不同类型的保姆和家政服务公司之间的法律关系不同,它们之间或者存在居间法律关系,或者存在劳动法律关系。家政服务公司和雇主之间,或者存在居间法律关系,或者存在承揽合同法律关系,依据家政服务公司和雇主之间的法律关系不同而区别对待。第三章以常见的保姆人身权利遭到侵害的现象为出发点,重点分析如何维护保姆的人身权利。涉及到保姆人身权利救济的若干问题,则以保姆人身权利遭受雇主侵害,受到第三人侵害,自我侵害为立足点进行分析,并提出相关的救济对策。第四章论述保姆人身权利救济的预防机制。更多还原

【Abstract】 Nurse personal rights are violated, especially displaying in the news report. This article is dedicated to elaborate nurse personal rights from a legal perspective through numerous news events. The article is divided into four chapters, chapter I is the analysis of the status of nurse industry, the rationality of the existence of the nurse service industry and the problems that existed in the nurse market, and the author will classified the nurse in three types. Chapter II is to elaborate legal relationships in the nurse market. Three areas is concerning nurse, domestic service company and employer. The author believe that the relationship between nurse and employer is contractual relationship. The legal relationship between nurse and domestic service company should be intermediary, and also their relation should be labor contract. The legal relationship between domestic service company and employer can be intermediary ,and also can be contractual relationship , based on the different legal relationship between employer and nurse .Chapter III is to state nurse common personal rights have been violated at the starting point, and focused on how to safeguard the nurse personal rights.
