【摘要】 在我国当前反腐败格局中,职务犯罪的侦查对打击和预防这类犯罪起着关键作用,因而职务犯罪侦查机制的良性运行是至关重要的。然而现实中由于侦查机关自身和诸多外在因素的阻碍,职务犯罪侦查并没有充分发挥其惩治犯罪和保障人权的应有作用。究其原因,一方面检察机关的职务犯罪侦查权设置不完整,另一方面,既有的侦查权却又存在滥用虚置的状况,这使职务犯罪侦查在不同程度上存在问题,效果不佳。以机制研究的主要方法,首先对职务犯罪侦查机制的结构与过程进行分析。然后,在此基础上,探讨阻碍当前职务犯罪侦查机制良性运行的主要因素有:现行立法不完善、检察机关现行的多层领导体制、侦查工作机制不完善、检察机关行使职务犯罪侦查权不规范等。根据我国检察机关职务犯罪侦查机制运行存在的问题,要使职务犯罪侦查机制良性运行,就需要从完善相关立法、改革领导体制、完善工作机制、强化监督与制约机制等方面着手改善。概言之,通过立法赋予检察机关完整的职务犯罪侦查权和通过监督制约机制防止侦查权滥用,是改善当前职务犯罪侦查机制运行,并保障其良性运行的必由之路。更多还原

【Abstract】 In the our country currently ,the situation of anti-corruption, official crimes of investigating play a key to prevent . So,good investigating mechanism of official crimes is very important.However, official crimes of investigates have no well exertive its cure crime and guarantee human rights,as result of investigating mechanism of oneself and many external factors,.First, the official crimes of organization to investigate a power constitution on the other hand not complete, the condition investigated the power but again existence abuse on the other hand and currently to place falsely, this makes the job crime investigate to exist a problem on the different degree, ineffective.With mechanism research of main method, investigate structure and process of mechanism to carry on analysis to the job crime first.Then, on this foundation, the study obstructs the main factor that the current job crime investigates the mechanism positive movement to have:The current lawmaking isn’t perfect and check a organization several current leadership systems and investigate a work mechanism not perfect, check the organization exercise a job crime to investigate power not norm etc..According to our country the existent problem of the mechanism movement, make the official crime investigate the mechanism positive movement, need to lead a system from the perfect and related lawmaking, reform, perfect work mechanism, enhance direct and check and supervision mechanism etc. to begin an improvement.In a word, the official crimes which gives check the organization integrity through a lawmaking investigates power and passes a direct check and supervision’s mechanism to prevent from investigating a power abuse, improving a current official crimes to investigate mechanism movement, and guarantee its positive movement necessarily from it road.更多还原
