【摘要】 舆论监督与新闻侵权——从富士康对《第一财经报》记者诉讼案谈起新闻学专业研究生：刘馨指导教师：周啸天2006年6月，“富士康”以侵犯名誉权为由，起诉《第一财经报》的记者并向相关报道的记者和编辑提出了天价索赔，虽然这场官司最后以双方的和解宣告结束。但是，近年来，随着新闻媒体舆论监督的范围不断扩大，新闻自由度不断增加，新闻媒体舆论监督过程中由于种种原因所引发的相关侵权事件也日益增多。针对这一情况，本文对新闻舆论监督与新闻侵权做了较为详细的探讨。对舆论监督的定义、特点、范围以及舆论监督过程中可能导致新闻侵权的原因进行了较为详细的分析和研究。同时，对不同媒体在舆论监督过程中容易造成的新闻侵权种类做了相应的归纳和总结并对新闻媒体如何避免、防范和应对新闻侵权做了必要的阐述。新闻媒体代表广大受众履行自己的舆论监督职能本来无可厚非，但是在具体的职能行驶过程中，由于一些主管和客观的原因会造成对被监督对象的权利侵犯。这种侵权有的是可以避免的，而有些所谓的侵权却是一种恶意诉讼。对新闻媒体所引起的新闻侵权无论是故意还是无意识的，新闻媒体的工作人员都无法逃避责任。但是，新闻工作者如果在新闻监督过程中，就能严守新闻人的责任，秉着客观、公正、真实的态度去报道新闻事件，在平时能不断加强自己的法律素养和新闻专业素养，那么如此以来新闻侵权事件的发生率将会降到最低。此外，面对一些恶意诉讼，新闻人也不能甘愿屈服，在平时的采访报道过程中有意识地收集资料和证据，通过法律来应对类似的恶意诉讼，以此来保护自己的合法权益不受侵犯。同时，我国新闻法学界正在引进和研究西方国家的新闻侵权的抗辩理由(有利于新闻媒体免责的理由)，通常，国际上公认的新闻纠纷的三大抗辩理由是真实、特许权、公正评论。如果，我们新闻人在具体的新闻活动中是正常履行自己的权利，那么这样的抗辩理由是极大有利于新闻工作者的。更多还原

【Abstract】 Fushikang prosecuted the First Economic Daily Newspaper because of reputation infringement. They asked for expensive compensation from the reporter and editor about the report. Though the case ended with peaceful result between them, the extent of journalism supervision enlarged. The degree of news freedom has been increased continually. The news infringement of right has been increased because of all kinds of reasons. As for it, the study about news public opinion and news infringement of right is finished in details. The definition, character, scope and reasons during news supervision has been studied carefully. At the same time, all kinds of news infringement that happens easily during news supervision has been analyzed and summed up. Meanwhile, how to avoid and prevent news infringement right is elaborated necessarily.Standing for all kinds of readers, listeners, spectators, News media carries out the obligation of supervision. That is right. However, news infringement of right often happens because of all kinds of reasons. Some of the infringement can be avoided. But, some can not be avoided. Many infringement of lawsuit is baleful. Whatever the reasons, News reporter can not escape the responsibility. But ,if news reporter can learn more about law and news knowledge, during their report, they can pay more attention to impersonality, equity, many infringement of right can be avoided. What is more, During their work, they must collect some proof, then, news reporters can use law to protect their own right.At the same time, our law circle has introduced into foreign demurring reasons.
