【摘要】 理念来自于实践又对实践产生引导作用,当代中国的法治理念在我国的法治实践中产生同时指引着当代中国法治的进路。当代中国的法治理念就是关于社会主义法治的信念、观念和思想。当代中国的法治历程充满坎坷,几十年间法治理念及其思维方式的变革和转换就是对这一进程的真实写照。建国之初,在阶级斗争理论基础上产生的对法的功能的认识,可以称作“工具论”的法治理念。后来,在“文革”期间,由于受到法律虚无主义的影响,抛弃了法这种治国工具,转而实行人治,导致治国道路上的惨痛失败。改革开放后,重新认识到法律在治国中的重要性,这一时期,人们在看重法律的手段性价值功能的同时,也开始注意到了法律的目的性价值功能,开始把民主法制建设同社会主义现代化建设紧密联系在一起,并进而产生了“依法治国”的社会主义法治理念。在依法治国理念的指引下,党中央确立了到2010年形成有中国特色的社会主义法律体系的宏伟目标。在实现这一目标的进程中,法治理念的变革继续深化,依法执政和依法行政就是最近10年我国法治理念变革产生的两大主要思想成果。当代中国法治理念变革的过程中,其思维方式也发生着重大转换,依法治国与以德治国并举和构建社会主义和谐社会就是法治思维方式转换的突出表现。依法治国与以德治国从不同层面、以不同方式、通过不同机制,在社会生活的不同领域发挥各自的作用和影响,二者是辩证的统一,作为治国的两种方略,二者缺一不可。构建社会主义和谐社会是当代中国法治建设所要达到的理想目标和最高境界,这一目标的确立,给社会主义法治建设提出了更高的要求。在这一目标指引下的法治,既是达成社会和谐的保障,也是和谐社会的必然要求。更多还原

【Abstract】 The idea comes from practice and has the guidance function to thepractice.The contemporary China’s ideas of rule of law are produced in ourcountry’s rule of law practice and simultaneously are directing thecontemporaryChinarule oflawprogress.ThecontemporaryChina’s ideas ofrule of law are about the socialism rule of law’s faith, ideas and the thoughts.The course of contemporaryChina’s rule of law is full of frustrations. At thebeginning of the foundation of our nation, to law function’s understandingmay be called as“the tool theory”. After the reform and opening, Chineserealized the importance of law in manage state affairs again. In this period,the people had a high opinion of the law’s instrument value and at the sametime also started to note the law’s purposeful value function.And thenChinese started to relate the democracy and legal system to socialismmodernization closely, and then had the socialism rule of law idea—rulingthe state bylaw. Under the guidance of rulingstate bylaw, the Central PartyCommitteeestablishedthegrandgoalofformthesocialismlegalsystemwiththeChinesecharacteristics to2010. Inthe course ofrealizethis goal,ideas ofrule of law reform continue to deepen.Ruling according to law and administration by law are two big main thought achievements which haveproduced in recently10 years’transformation of our country’s idea of rule oflaw. During the transformation course of contemporary China’s idea of ruleof law, its thinking modes are also having the significant transformation.Ruling the state by law and ruling the state by morality and construct thesocialism harmonious society is the prominent performance of the rule oflaw’s thinking mode transform. Ruling the state by law and ruling the stateby morality are dialectical unification, as two plans which rule a nation, thetwois indispensable. Constructs thesocialism harmonious societyis theidealtarget and the highest boundary which the contemporary China’s rule of lawconstruction. This goal establishment have set a higher request for thesocialismruleoflawconstruction.Underthisgoalguidance,ruleoflawisnotonlytheinsuranceofachievetheharmonioussociety,butalsotheharmonioussociety’sinevitablyrequest.更多还原
