【摘要】 为了推动我国职业篮球运动的发展,完善体育法律体系建设,营造公平竞争的篮球市场环境。必须加大对于篮球经纪人经纪行为的监管力度,力争杜绝违规现象的发生,确保篮球经纪人在职业篮球的发展中起积极作用。本文从篮球经纪人经纪行为与现状入手,由体育管理体制、具体法律法规两个方面,研究如何更好的规范我国篮球经纪人经纪行为。本研究的主要结果:1.篮球经纪人是篮球职业化的产物,我国篮球经纪人处于挑战与机遇并存的环境中。规范是保证其发挥积极作用的前提。其核心业务是有关运动员的经纪服务。篮球经纪行为具有单一性与多样性的特征:单一性指服务对象的单一,多样性指服务的多样与全面。其核心品质是专业性。篮球经纪人应该是篮球、法律、财务等专业人才构成的团队。2.我国目前有14名篮球经纪人,主要集中在北京。能够从事国内外运动员、教练员交流;运动员、教练员及球队商务代理和商务推广;组织推广商务赛事;赞助中介活动;其他篮球经纪活动。由于法规不健全,目前在佣金、合同等方面存在问题,直接导致了滥收佣金、合同欺诈等违法行为。在现有体制下篮球经纪人的生存空间窄小。3.我国现有的管理体制存在如下问题:仲裁机构缺乏专业性,没有建立体育仲裁机构、体育法律研究机构。政府部门陷于具体事务中,不利于规范工作。现行职业篮球管理体制必须改革。4.规范篮球经纪人经纪行为的法规主要为《经纪人管理办法》、《篮球经纪活动暂行管理办法》、《关于加强我市体育经纪人管理的通知》及篮球管理中心制定的有关法规。《体育经纪人管理办法》仍未出台。规范工作是在国家的整体法律框架下进行的系统工程,必须完善体育法律体系建设,加强民法与体育法的结合研究。尽快建立体育法律仲裁机构。5.立法存在的问题:①法规制定过程中,工商部门与体育总局之间缺乏沟通与交流,法律条文没有明确到具体的篮球经纪行为,不能完全做到有法可依。②现有的体育法律研究没有与民法研究相结合。③执法机构不健全,执法人员不能满足规范工作的需要。6.我国篮球经纪人经纪行为规范趋势:逐步解决体制的问题,篮球管理中心与篮球协会真正的脱钩,发挥各自的优势。建立体育法研究机构,为管理部门立法和修订法规提供智力支持。建立规范体系内部的法律解决机制,发挥体育法律仲裁机构、体育律师协会、运动员工会等组织在规范中的作用。更多还原

【Abstract】 In order to provoke Chinese professional basketball development, cultivate fair competitive market atmosphere, we have to . This paper basing on Chinese basketball agents’practical problems, with an eye to sports management system and actual law, analyzes how to do better in supervising Chinese agents’behaviors. Results below,1 Basketball agent is the outcome of basketball professional development, but Chinese basketball agents are developing among challenges and opportunities. First of all, the precondition of making sure its taking effect is the criterion , core of which is on serving for athletes. Basketball agent behavior is characterized by two terms: oneness and multiformity, the former serve the single object, the latter serve objects in the round, what’s more, its core is professional serves. Basketball agent must be a team composed of the professionals coming from basketball, law, finance and so on.2 Up to now, only 14 professional basketball agents are in China, who centralized in Beijing mostly. Sports management system presses the developing space of basketball agents, for lacking of strong market supervision, some illegal agents also take activity, which increase the basketball agents’survival burden further. Therefore, in our country, basketball agents’positive effect has not released completely.3 The developing experience of American basketball agent-----exert the roles of sport mediation institutes, sport associations, professional alliance, labors union and so on. But in our country, the existing mediations are lack of professional traits, lack of the sport mediation and institutes studying the sport law. Sport managing governments were blown into the whirlwind of dealing with trifles, which don’t profit supervising agents. So we must reform the existing professional basketball management system.4 According as“administration rules of agent”,“temporary rule of basketball agents”,“on strengthening sports agents’administration”and some other rules were used to manage basketball agents. Criterion work is systemic engineering directed by the whole national law frame. We must perfect sport law construction according to Sports Law and Civil Law, especially establish sport mediation,5 During the period of basketball agent legislation, there are the following problems. (1) no cooperation and intercourse among different departments. (2) Legislation and emend are both quick, but not the whole system. (3) Not attach importance to study civil law.6 To solve the problems, there are the tendencies below: Basketball associations separate from the basketball administration center, take their own advantages. Establish professional institutes to study sport law, which support administration department for legislation and emendation. Establish systemic law to solve sport problems in inner, exert the roles of sport mediation institution, sport lawyer association, athlete union and so on.更多还原
