【摘要】 目前，我国广大科技工作者正积极投身在民族复兴的历史使命中，但也有少数人员利用职务的便利实施了破坏性极强的犯罪。事实证明，科技人员利用职务便利实施的犯罪，所造成的危害更大，更需要良好的预防措施。因而，加强对科技人员职务犯罪的研究，充分认识此类犯罪的危害并提出前瞻性的预防措施已成为一项重要课题。而目前国内外刑法学和犯罪学领域对此问题的研究，大多是针对具体的个案加以论证与说明，缺乏整体、系统的研究和把握。作为一名在科研单位从事检察工作的检察人员，笔者认为有必要对科技人员这一特定人群的职务犯罪问题进行研究探讨。在本论中，笔者主要运用实证研究的方法从科技人员职务犯罪的概念及内涵界定出发，对此类犯罪的特点进行概括和总结；并通过对现阶段科技人员职务犯罪现状的剖析，从此类犯罪的成因及危害、目前在防范、打击此类犯罪方面的现状与不足、以及我们应当怎样构筑一套合理且有效的预防与打击此类犯罪的机制等几个方面进行论证，同时结合笔者工作实际，重点探讨检察机关在预防和控制此类犯罪方面应当进行的改革工作。更多还原

【Abstract】 At the present time, most scientific and technical personnel of China are working hard for the revival of nationhood. But a small number of scientific and technical personnel have been committing very serious functionary crimes. Facts show that functionary crimes committed by scientific and technical personnel have more harmful influence. In this way, more attention should be paid to the research on functionary crimes of scientific and technical personnel, and more better precautionary measures should be taken to prevent functionary crimes. Nowadays, in the field of criminal jurisprudence and criminology at home and abroad, most of the research focuses on only some specific cases, however, less holistic and systemic research has been put forward. So it is necessary for us to do more research on the functionary crimes of scientific and technical personnel.In this paper, the author starts from the conception of functionary crime committed by scientific and technical personnel and summarizes their common characteristics. While analyzing the deficiency of precautionary and anti-crime measures in China, the author talks about the present situation, cause of formation, harmfulness and better future precautionary measures of these kinds of crimes. Moreover, based on his own working experience, the author also talks more about how prosecutorial organizations should take actions to promote reform of preventing and cracking down on these kinds of crimes.更多还原
