【摘要】 中国传统思维方式是中华民族文化的精神内核,是世界上独一无二的思维方式。它具有经验直觉性、整体性、伦理性、实用性、辩证性等特点,正是这种独具特色的传统思维方式决定着中华文化特有的风貌。而中国传统思维方式的形成又是其特定历史条件的产物,中国古代独特的自然地理环境、成熟的农业生产方式、别具一格的语词系统、中央集权式的君主专制政治制度以及其他文化因素等多方面因素的综合作用,决定了中国传统思维的走向,使其呈现出与西方人不同的思维倾向。这样一种思维方式对中国古代法文化产生了重要影响,促使了法律的道德化、法律规则的具体化、法律的集团本位、法律的工具化等中华法系诸特点的形成。近代以来,随着西方国家的入侵和西方法治文明的引入,中国开始了法制变革的历程,这对中国传统思维方式产生着重大冲击。而且,我国现在所进行的法治建设也要求一种新的思维方式取代传统思维方式。然而由于传统思维方式存在的根源尚未被完全消除,加上其本身所具有的超强的稳定性,传统思维方式仍然在影响、甚至支配着广大民众的心理和行为,并在法治实践中静悄悄地消解、甚至扭曲着国家制度层面的追求。这是我国虽经历了百余年的法治现代化的进程,仍然未能建成现代法治社会的深层原因所在。中国传统思维方式的意蕴是相当丰富的。不可否认,其中存在着对我国现代法治建设有碍的因素,但是,它也同样包涵着对目前的法治建设有益的历史智慧。因此,我们必须全面地、正确地估量中国传统思维方式。一方面发掘、利用传统思维方式中有益于现代法治建设的成份;另一方面改造、消除对现代法治建设有不利影响的因素,创造出适应我国现代法治建设需要的新的思维方式和智慧。更多还原

【Abstract】 The mode of Chinese traditional thinking is the spiritual kernel of Chinese nation’s culture and is the unique mode of thinking in the world. It is with such characteristics as experience and intuition, entirety, ethic, practicability, dialectics and so on, and it is precisely this kind of mode of traditional thinking which determines the unique style of the Chinese culture. Forming of the mode of Chinese traditional thinking has its particular historical conditions, and the comprehensive function of reasons in many aspects such as the unique natural and geographical environment in ancient times in China, the ripe mode of agricultural production, the peculiar system of words and phrases, the political system of autocratic monarchy, and other cultural factors, determines the trend of Chinese traditional thinking, and makes it demonstrate the thinking inclination different from that of westerners. Such mode of thinking exerted an important influence on ancient legal culture of China, and made Chinese legal genealogy form such characteristics as the morality of law, specification of legal rules, the standard of group of the law, the utilization of the law, etc.Since modern times, as the western countries invaded in China and civilized rule of law was introduced, China had begun the course of the reform of legal systems. This brought great assault to the mode of Chinese traditional thinking. Moreover, the construction of modern rule of law that our country carries on now requires a new mode of thinking to replace the mode of traditional thinking. But it is still influencing, even arranging psychology and behavior of people, and it is clearing up, even twisting the pursuit of the aspect of state systems in practice of law quietly because the original reasons why it exists has not been totally dispelled yet, in addition, with its super strong stability. This is the deep reason why our country still fails to build up a modern society governed by law although the process of constructing modern rule of law has been going through over one hundred years.The connotation of China’s traditional thinking is quite abundant. Undeniable, factors that hinder the construction of modern rule of law in our country exist in it. However, it contents historical intelligence beneficial to present construction of ruling of law too. So, we must appraise the mode of Chinese traditional thinking in an all-round way, correctly. On one hand, we should explore and utilize the compositions helpful to construction of modern society governed by law in the mode of traditional thinking; On the other hand, we should transform and dispel factors with adverse effect on construction of modern society governed by law in it, and create a new mode of thinking and intelligence which meet the need of construction of modern society governed by law in our country.更多还原
