【摘要】 学校内部规则是学校法律问题研究的重要内容。对其的价值研究不仅具有一定的理论价值，而且对于学校法律实践具有很强的指导意义。从严格意义上讲，学校内部规则是规章制度而不是法律规范，是教育法律法规在学校中的具体化。从这个角度出发，本文以哲学和法哲学中的价值理论为中心，运用价值理论研究的方法对学校内部规则的价值作了分析。学校内部规则是学校为实现教育管理目标和顺利完成教育工作及任务，依据有关的法律法规，方针政策和工作实际制定出的用来对其内部成员进行管理的各种行为规范。学校作为学校内部规则的制定主体，制定权是法律授权的，具有它合法性的一面，内容涉及学校教育教学与管理活动的方方面面。学校内部规则的制定必须以教育法律法规和其他上位法律文件作为依据。其具有一定的法律效力。学校与教师、学生是以行政法律关系为主，这种关系也同样表现在学校内部规则的制定和执行中。学校内部规则作为具有法律性质的制度，它的价值和价值目标体系是研究的主要内容。其中与学校内部规则相关的学校管理者、教师、学生是价值主体，学校内部规则是价值客体。基本的价值关系是这些主体之间权利的配置关系。它的价值目标体系应以秩序、效率、公平、正义、自由和发展作为内容。在价值研究的基础上，学校内部规则的合法性与合理性是价值能否实现的重点。合法性上，实质合法性主要是指学校内部规则的内容上符合它的实质价值选择，能被社会接受、认可并遵守。它要求学校内部规则按法律优先原则不得与上位法抵触；按法律保留原则不侵犯内部成员的重要权利；按越权无效原则不超越权限盲目扩大自由裁量权。形式合法性主要是指学校内部规则从制定到执行等一系列过程中形式和程序与法律规定的符合性和合法性。它主要要求按正当程序原则对学校内部规则的制定、执行与救济过程进行规范。关于合理性，实质合理性主要是指内部规则的制定应该合乎教育目的与教育规律，形式合理性指文本上要明确、科学、符合逻辑。我国学校内部规则以效率和秩序为价值取向，导致目前学校内部规则的制定实施存在一些问题即：在观念层面，对学校内部规则的定位模糊，学校内部规则价值的片面理解，忽视甚至损害学校内部成员的合法权益。实体层面，教育法律法规的滞后，相关法律法规不健全。程序层面，学校内部规则的制定，执行和后续的救济都严重缺失。学校内部规则应以价值目标的和谐统一作为价值取向，为此必须树立正确的价值观念和法律意识；健全国家基本教育法律法规；完善学校内部规则；规范法律调控和救济。更多还原

【Abstract】 School’s byelaws aim is the important part of the questions of school laws. Its The Value Analysis has not only great theoretical significance but also has instructive significance in many realistic issues of school laws. School internal administrative regulation is not a legal norm, School internal administrative regulation is the extension of education law at school. Form this perspective, this study takes the valve theory on Philosophy and laws Philosophy as the heart, this research analyses school internal administrative regulation using the method of value and the integrated method.School internal administrative regulation should includes kinds of action norm which is found to manage internal members for achieving education target and accomplishing education work by school according laws, policy and reality. School is the main body of formulating School internal administrative regulation; its power is conferred by laws. It has its face of validity. Its content involves different aspects of school teaching and manages activity. Its basis is education laws and other laws documents. School internal administrative regulation has fixed effects of laws. As the authorized organization by law, is formed by administrative department and school, school and its internal members including teacher and student is the administrative laws relation. The relation also shows in the process of formulating and implementing School internal administrative regulation.As a system has the laws characteristics, the value and value target system of School internal administrative regulation are the research main body. School managers, teacher, students are the main body of value. School internal administrative regulation is the objectivity of value. The basic value relation is the allocate relation of power with main bodies, the value target system includes procedure ; efficiency; justice; equity freedom and development. On the basis of value analysis, the validity and rationality of School internal administrative regulation are the important of achievement of value. The essence validity of School internal administrative regulation importantly point to that its content accord with essence chaise of value and can be accepted, approved and observe d by society. It should not against the upon law according the principles of laws retain, It should not infringe the important rights of internal member according laws priority, it should not overstep limits of authority and extending the power of free ruling according invalid of exceed power. As form validity, it does about the rightful procedure principle. Its form validity point to its process of formulation and action accord with the laws. On rationality, its essence rationality request School internal administrative regulationshould follows educational goal and educational law. The form rationality request the text of School internal administrative regulation should be clear, scientific and logical.The actual value of procedure and efficiency lead to some questions: on ideas, the position is blurred to School internal administrative regulation, the unilateral understand on the value lead to ignore the legal interest of inter members in school or harm. On the layer of substance, the education laws fall behind, laws related to it is not perfect. On the layer of procedure, the formulation, implementation and relieve lack seriously. School internal administrative regulation should regard as the value aim of harmony and unite as the value tend. So we must formulate rest value idea and laws ideology; amplify basic laws of country; complete School internal administrative regulation; form laws regulation and relieve.更多还原
