【摘要】 近年来，转基因生物在技术研究、产业化应用等方面都取得了令人瞩目的成就，转基因产品在解决食品短缺、增进人类健康、节约能源和保护自然资源以及生态环境等方面发挥着越来越重要的作用。大多数国家政府对转基因技术研究及应用都持有积极态度，越来越多的公众认可转基因产品进入他们的生活领域。但是有关转基因生物引发的安全性问题也越来越严重，是许多国家发展转基因技术及其产业所必须面临的重要课题。我国转基因生物技术的研究和应用取得了长足的进步，在一些研究领域甚至达到国际先进水平。从事转基因生物研究的机构和人员数量不断增加，公众对转基因生物及其产品也有更进一步的了解。国家为了规范转基因生物技术产业先后颁布了许多相关的法规和规章，这些条例和实施办法的出台大大促进了我国转基因生物技术产业的健康持续发展。然而，在我国加入WTO的新历史背景下，我们必须不断完善我国现有的转基因生物安全法律法规，使我国转基因生物安全管理能够适应我国转基因生物技术发展的步伐，尽快实现我国转基因生物安全管理的规范化、法制化，并与国际接轨。本文将通过对我国以及发达国家转基因生物安全立法现状的分析，寻求适合我国转基因生物安全管理的法律途径，建立一部我国转基因生物安全基本法。在此基础上完善我国转基因生物安全法律体系，提高我国转基因生物安全管理水平，增强公众的转基因生物安全意识，使我国转基因生物事业能够沿着健康的轨道向前发展。更多还原

【Abstract】 In recent years, the GMO research and industrial applications have made remarkable achievements. GMOs in resolving food shortages and enhance human health, energy conservation and protection of natural resources and the ecological environment has played an increasingly important role. Most national governments hold a positive attitude to the research and application of transgenic technology, and more and more public acceptant the genetically modified products to enter their fields of life. However, the safety of genetically modified organisms has caused more serious problems. And has being an important subject making many countries facing to in their transgenic technology and industry.Chinese GMO research and the application of technology have made considerable progress, and even reached the international advanced level in some studies. The number of staff engaged in GMO research institutes is keeping increased, and the public has further understanding to the GMO products. To regulate GMOs technology industry, the State has promulgated many laws and related regulations. These regulations have greatly promoted the sustained and healthy development of the industry of the Chinese GMO technology. However, in the new historical context of Chinese accessed to the WTO, we must continue improving our existing GMO safety legislation, to make our GMO safety managements adapting to the pace of technological development of genetically modified organisms. Realizing the management of Chinese transfer gene biology safety in the standardization and the legal system, and with international connects rails.This paper will be developed and passed on GMO safety analysis of the status of legislation, seeking appropriate legal ways of Chinese GMO safety management, and establishing our law on the safety of genetically modified organisms. On this basis, coordinating the legal system for the safety of genetically modified organisms, improving the level of safety management, and increasing the public awareness of genetically modified organisms safety, making the GMOs enterprise of our country to be able to move forward along the health track.更多还原
