【摘要】 警察行政强制措施问题不仅关系到行政相对人的切身利益，也关系着行政职权的有效行使。目前，域外法治国家和一些地区都确立了较为完善的行政强制制度，警察行政强制行为在法律的规制下在解决社会问题的实践中发挥着重要作用。而我国由于对行政强制制度的研究起步较晚，理论积累不足，导致警察行政强制措施问题研究也相对落后，全面细致的警察行政强制措施法律控制问题的研究也就相对较少。在实践中，警察行政强制措施又屡屡出现对行政相对人权益进行侵害的违法行为，这正是由于立法上、执法上、救济上规则的缺位，使得警察行政强制措施在实践中的运用呈现混乱状态，阻碍了其作用的充分发挥。基于此，本文选择以警察行政强制措施制度作为研究对象，通过本文对警察行政强制措施制度的研究，拓展传统警察行政强制措施制度研究范围，丰富了警察行政强制措施法律控制的理论内容，有助于丰富和繁荣我国行政强制制度的研究；本文对警察行政强制措施法律控制的分析和阐释，为我国在现实中建立完善警察行政强制制度提供了理论基础和基本构想，有助于我国立法对警察行政强措施制度的规定和在实践中对其规范运用，尤其是对我国目前的行政强制立法具有积极促进作用。更多还原

【Abstract】 The compulsory administrative measure questions of police of the summary not merely concern the vital interests of the relative people of the administration, concerning the effective enforcement of the administrative power too. At present, the overseas country governed by law and some areas all establish the comparatively complete administration and force the system, police’s administration forces the behavior to play an important role in practice of solving the social concern under the structure of the law. And because our country forces the research of the system to start to the administration relatively late, the theory is accumulated insufficiently, lead to the fact police compulsory administrative measure problem study too relative to lag behind, overall careful police compulsory administrative measure law control research of the problem relatively less. In practice, police compulsory administrative measure appear, go on illegal activities that encroach on to administration relative people rights and interests repeatedly, this legislate, have, enforce the law, pay, relieve, pay regular omission just, make the application in practice of police’s compulsory administrative measure in musty condition, the ones that have hindered its function are given full play to.Because of this, this selected works select and regard compulsory administrative measure systems of police as the research object, through the study on compulsory administrative measure systems of police of this text, expand traditional police’s compulsory administrative measure system research range, the theory content that abundant compulsory administrative measure laws of police control, facilitate enriching and prospering the administration of our country and forcing the research of the system; This text analysis and explanation to that compulsory administrative measure laws of police control, have offered the theoretical foundation and basic idea for the fact that our country sets up and improves police’s administration to force the system in reality, facilitate our country’s legislating to the regulation of system of the strong measure of police’s administration and using their norms in practice, especially legislate to have positive facilitation by force to the present administration of our country.更多还原
