【摘要】 民事保全制度作为民事诉讼法上的一项重要制度,日益发挥着重要的作用,尤其是在执行难问题日益严重的今天,民事保全制度对于保证将来判决的有效执行,维护当事人的合法权益具有极为重要的价值。而现行民事诉讼法对民事保全的规定极为简单,有许多规定得不成熟的地方,其在理论研究和实践中的不够重视必然会极大的削弱其价值与功能的发挥,因而需要进一步完善。本文分析了现行民事保全制度的缺陷所在,阐述了对民事保全制度进行改革的理论基础,并在借鉴国外立法的基础上,提出了保全制度设计上的构想。本文的写作分四个部分进行:第一部分:民事保全制度的缺陷分析。首先介绍了民事保全制度的立法现状,然后分析了民事保全制度在立法上和司法实践中的缺陷,最后对民事保全制度缺陷产生的原因进行了探讨。第二部分:民事保全制度改革的理论基础。这一部分从四个方面进行研究,即民事制度的价值取向、民事保全制度设立的目的与功能、民事诉讼模式发展趋势的要求及程序性权利之保障的要求四个方面来探讨对保全制度进行改革的理论基础。第三部分:民事保全制度的比较法考察。该部分在分别介绍英美法系和大陆法系不同国家保全制度的相关规定,并在对之进行比较的基础上,提出了我国可以借鉴的部分。第四部分:民事保全制度改革和完善的构想。本部分首先介绍了民事保全的总体制度构想,即将民事保全制度分为财产保全和行为保全两个并列的制度,然后分两个部分进行了论述,即提出了对财产保全制度进行完善的具体制度构想,并对行为保全制度进行具体内容的构建。更多还原

【Abstract】 The system of civil securing, as an important system of civil procedure, plays an important role day after day. But out civil procedure provides very simply for this question and it needs further improvement. This paper studies this question and put forward a new designation for this system on the basis of introducing foreign legislates and analyzing foreign theories. There are three parts in this paper:Chapter one: Studies on our system of civil securing. It first introduces the historical resources of it and then defines its concept. After that, it introduces the system we are using now and analyzing its shortcomings both on substantive and procedural law as well as in practice. Last it discusses the causes of its shortcomings.Chapter two: The theoretical base of reformation of system of civil securing. This part includes two contents. such as its value, purpose and function, the developing trend and the request of safeguarding procedural rights.Chapter three: The comparison of the system of civil securing between two systems. The part is about its practical basis. It indicates the part that we can use by comparing the system of the common law and the civil law.Chapter four: My thought of reformation of the system and its improvement. The whole designation is to divide the system into property securing and action securing and then discuss these two parts separately. First it gives a concrete framework of the process of improvement of property securing and then gives a framework of setting up systematic act preservation.更多还原
