宪法视角下的农村基层政权建设

【摘要】 《宪法》和《地方组织法》分别对各自的地位、性质、职权作了规定：中国共产党是我国的执政党，乡镇党委是中国共产党在农村的基层组织，在乡镇政权中就处于执政党的地位；乡镇人大是乡镇一级的权力机关，是乡镇人民行使权力的机关；乡镇政府是行政机关，是整个国家行政机关的最低的一级。在实际的工作运行中，一些地方的乡镇党委、人大、政府各自的角色与法律的规定出现了偏差，各部分对自己的法律地位认识不清，工作中出现了职权交叉、党政不分的情况。乡镇政权各组成部分的职权错位也影响乡镇政权自身的法律职权的行使，使当前农村许多地方的乡镇政权无法正确的履行职责。建设现代化的中国必须建设现代化的政府，解决“三农”问题也必须要求我们的乡镇政权具有现代化的视角和功能。本文在对乡镇党委、人大、政府各部分自身的工作职能和实践中的不足进行的分析的基础上，提出一些改革措施，进而梳理了乡镇政权各个部分的关系，实现乡镇政权各组成部分宪政地位回归，使他们能够相互协作，相互监督、制约，从而建设一个符合现代宪政要求，具有现代执政理念的农村基层政权，使其不仅能胜任当前的建设社会主义新农村的任务，更对整个国家的政权建设起到一定作用。更多还原

【Abstract】 The Constitution and the Place Constitutive law respectively make the definition to their status, nature, authority , that is , the Communist Party of China is our country’s party being in power, the party committee in the villages and towns is the basic-level organization, they are in the status of being in power in the villages and towns political power ; the National People’s Congress in villages and towns is the authority institution in the villages and towns level as well as the authority institution of the people in villages and towns; The government in villages and towns is the administrative institution, which is at the lowest level in the entire national administrative institutions. But in the actual work process , some party committees, National People’s Congresses and governments role and the legal stipulation appeare some deviation, they cannot clearly understand their own legal status, in the work had the situation which the authority overlapping, the party government are confused. The villages and towns political power each constituent authority dislocation also affects the villages and towns political power own law authority exercising, causes current countryside many places the villages and towns political power to be correctly unable correctly to fulfill the responsibility. Construction modernization China must construct modernized the government, the solution "three agriculture" the question also must request our villages and towns political power to have modernized the angle of view and the function.
