【摘要】 当前随着法治改革的深入，人们对证据给与了越来越多的关注。毕竟打官司说白了就是证据之间的较量。在这种情况下，如果我们关于证据的理论和法律规定本身就存在着相当多的问题，那无疑会妨害事实的认定甚至侵犯人权。证据种类是证据要面临的首要问题，证据种类担当着证据的“守门人”的角色。我们意在通过对证据种类作全方位的研究，目的是建立起标准统一、内涵丰富的证据种类制度，为对证据作进一步的研究打好基石。本文分析了证据种类封闭性、混乱性的特征，将证据种类重新认定为：物证、书证、人证三类。之后逐个分析了三种证据新型表现形式(测谎结论、电子证据、科学证据)的证据种类归属：测谎结论属于鉴定结论；电子证据不是独立的证据种类，而是分属于物证、书证、人证之中的证据类型；科学证据不是独立的证据种类，而是包含在现存证据种类之中的一些证据的统称。本文不仅将传统证据种类进行了重新划分，而且将三种证据新型表现形式(测谎结论、电子证据、科学证据)放在证据种类的视野内进行研究，并对其进行证据种类的定位。从而将证据种类的问题力争做一个全面的、科学的、合理的研究。更多还原

【Abstract】 With the development of law reform, people pay more and more attention to evidence. In this case, it is no doubt that we will not recognize the truth of the case and even encroach the human rights if we have many problems about the evidence theory and evidence legislation . Evidence category is the first problem on f evidence. Evidence category play the role of the evidence doorkeeper. We intend to do the omni-directional research on the category of the evidence type to establish standard evidence category system, then provide the foundation stone for the further research. This article has analyzed the containing and chaotic characteristics of evidence category and conclude again to three types: material evidence, documentary evidence, witness, then analyzed respectively the position of three new evidence pattern of manifestation (conclusion of psychology testing, electronic evidence, scientific evidence) : conclusion of psychology testing is expert evidence; The electronic evidence is not independent evidence catagory , it is one of material evidence, documentary evidence and witness; The scientific evidence is not also independent, it is contained in the extant evidence catagory .This article not only rebuilt the position of the traditional evidence category, but also research and locate three new evidence pattern manifestation (conclusion of psychology testing, electronic evidence, scientific evidence) by putting them in the field of the evidence category. So we try to do an all-round, scientific, rational research on evidence category.更多还原
