【摘要】 学位论文电子化利用的主要形式，即学位论文数据库目前已经进入全面应用阶段，但是学位论文数据库的发展依然存在较多法律问题。首先，学位论文的著作权归属问题。本文认为学位论文的著作权归属应当根据学位论文创作的具体情况区分为以下四种情况：学校享有著作权的情况、著作权归属于导师的情况、著作权归属于创作者和著作权归属于委托单位的情况。简单的认为学位论文著作权属于某一个主体的归类方法都是错误的。同时在此基础上也应当明确高校对于学位论文享有一定的著作权权利。其次，由于学位论文数据库采取的面向全社会的商业运作模式，因此学位论文数据库对学位论文的复制、数据库编辑和下载等应用应当取得著作权人或其他有权人许可。我国目前的学位论文数据库许可模式是以“三方主体—两层授权”为特点的。此种授权模式存在以下问题：第一，授权范围不明晰；第二，授权主体不适格；第三，授权成本依然偏高。而由于学位论文其自身的特性，合理使用制度、法定许可使用制度和著作权集体管理制度等著作权权利限制制度也很难应用到现有许可模式当中。因此，解决上述学位论文数据库许可模式的法律问题必须从学位论文管理模式和学位论文具体应用方式中寻找解决方法，本文认为首先应当修改完善学位论文使用权授权声明，通过声明来明确著作权归属并保证学校获得明确授权：其次通过论文保密制度来规避学位论文数据库许可应用中可能遇到的法律问题。最后要彻底解决现有学位论文数据库中的法律问题还应当从制度层面建立新的学位论文许可模式。更多还原

【Abstract】 The dissertation database has been now comprehensively applied in china. However, there are still some legal problems, the first of which is about the ownership of the copyright of the dissertations. The writer of this paper insists that the owners of the copyright of the dissertations should be classified, according to the specific conditions, into four kinds: the school, the supervisor, the author and the trust agent. So the idea that only the author owns the copyright of the dissertation is wrong. Second, since the Dissertation Database adopts the mode of commercial operation and caters to the whole society, it is required to obtain the authorized license for the copy and download of the dissertation, and the edition of the database.Now in china the mode of this authorization is specialized, which has such problems as follows : First, the range is unclear; second, the subject of the authorization is unqualified; third, the cost is high, etc.. Furthermore, because of the specific characteristics of the dissertations, it is difficult to apply the system of restrictions on the rights of the copyright, such as the Fair Use System, the statutory Use System , the System of Collective Administration of Copyrights, to the mode. Therefore, to solve those problems, we should focus on the management mode and the specific application form of the Dissertation Database.The writer of this paper insists that first, the authorized statement on the right of use of the dissertations should be revised and improved. The statement should make clear the ownership of the copyright and make sure that the school has the authorization. Second, the dissertation database should use the security system to avoid the legal problems possible to arise. Finally, a new dissertation licensing model should be established from the institutional level to resolve those problems completely.更多还原
