【摘要】 “依法治国”要求有法可依、依法办事。立法是法治社会的前提和基础，是实现“依法治国”方略的重要一环。建设与社会主义精神文明相符合的法律体系，应特别重视立法工作并加强立法伦理研究，因为良法是善治的前提，也是实现和谐社会的制度渊源。道德对立法起到积极的促进作用，社会主流道德所确立的基本价值通常也是法律所包含的基本价值。在立法活动中，立法主体为了反映时下的社会文明，必须要将代表时代价值观的道德规范、道德理念、道德精神融入到法律文化之中，最终通过一国的法律文本得以实现。合理性的立法活动所制定出的法律符合善的目标，符合社会的美德，表现为法的形式与实质的合德性。道德法律化指通过立法将一定社会的道德观念和道德规范转化或确认为具有国家强制力的法律规范的活动，这一特殊的立法手段使生成的法律蕴涵社会发展的道德价值标准，体现出法律对社会生活应有模式的价值追求，为社会主义法治社会的良法善治创造了前提条件和坚实基础。更多还原

【Abstract】 "Ruling by law" require handling affairs according to law. Legislation is the premise and basis to rule society by law, is the important stage to realize the strategy of "ruling by law" .Building a legal system according with socialist culture and ethics, should take a legislation seriously specially and reinforce legislation ethics research, because the good law is a premise in administering, and it is also a systematic origin to realize harmonious society. Morality play the actively role to legislation, Society main fundamental values established by morality is also the fundamental values contained by legal culture generally. In legislation activity, legislator in order to reflect the current social culture, must contain the social morality norms, moral ideas, moral spirits of times values into the legal culture, to realize it through legal norms of one country finally. Law worked out by the rationality legislation activity accord with the kind target and the virtue of society, showing that the form and essence of law meet the requirement of morality. The legislation of morals is the activity which transform or affirm certain moral ideas and moral norms of society to the legal norms which have force of state, the special legislation way made the law containing the value standard of social development and meeting the requirement of morality, embody out the value pursuit of the social pattern that it ought be by law. and create the premise condition and solid basis in administering by good law of the socialist legal society.更多还原
