论民办高校与政府的关系

【摘要】 20世纪80年代中期以来，由于我国市场经济体制的逐步建立和办学体制改革的向前推进，民办高等教育不断发展。民办高等教育的发展，既依赖民间资本的有力投入，更依赖于政府的有力支持。而政府对民办高等教育发展的支持重点体现为政策与制度建设的支持。政府提供的公平政策和良好的制度环境对民办高等教育的发展具有决定性的意义。本文尝试采用制度分析的视角对我国民办高校与政府的关系进行分析，重点探讨制度因素对民办高校发展的影响。全文一共分为三章。第一章阐释了民办高校与政府关系的现状。现状表明：民办高校与政府之间的关系的主导方面在于政府。政府在发展和规范民办高校时有举棋不定的倾向。政府既在鼓励民办高校的发展，但也在制约民办高校的发展。在民办高校发展的现实过程中，出现了政府管理的错位和民办高校存有的违规办学的倾向。第二章重点对民办高校与政府关系的现状进行了归因分析。笔者从制度分析的视角，从内在制度和外在制度两个方面进行了归因，认为国家本位私学观、民办高校内在规则缺失以及当下法律法规的不健全导致了民办高校与政府之间关系的不和谐。最后，本文探讨了政府与民办高校的关系的制度建构。认为民办高校应该回归公益性本质特征，并在此基础上建立现代民办大学制度；政府应该转变政府职能，变无限政府为有限政府和服务型政府，并要鼓励教育中介组织的良好发展。更多还原

【Abstract】 Because of the establishment of market economy and the reform of running school system advancing from the 1980’s. Non-governmental higher education has unceasingly developed. The development of non-governmental higher education depends on the non-official capital and the government’s support. And the government’s support for the non-governmental higher education mainly embodies the policies and institution construction. The justice policy and institution circumstance provided by government determines the development of non-governmental higher education. This article is trying to analyze the relationship between non-governmental higher education and government based on the analysis of institution, hoping this research can avail itself of the following study. Aiming this goal, this article analyzes mainly the current situation and the cause of the problems between non-governmental higher education and government.This article is divided into three parts. In the first chapter, author makes clear the current situation of the relationship between non-governmental higher education and government. The current situation indicates that the government determines the relationship between non-governmental higher education and government. On the one hand, the government supports the non-governmental higher education; on the other hand, the government restricts the development of non-governmental higher education. However, the non-governmental higher education has a few problems in the process of its development.In the second chapter, this article analyzes the reasons which caused the disharmony of the relationship between non-governmental higher education and government. Based on the internal institution and external institution, author considers that the country- orientated idea of private school, the deletion of non-governmental education’s internal rules, and the morbidity of law and policies are the main reasons.In the end, this article points out the pathway of re-constructing the relationshipbetween non-governmental higher education and government.更多还原
