【摘要】 体育体制改革是我国体育改革的主要问题，而体育社会化又是我国现阶段体育体制改革的关键。近些年来，作为体育社会化的重要成果，体育社团在我国得到了蓬勃的发展。但由于我国处于社会的转型时期，社会体育的管理体制尚不完善，加之现代意义上的体育社团在我国起步较晚，体育社团方面的管理经验存在不足。这些问题的解决和我国体育社团健康、有序的发展，都有赖于中国体育社团管理的法治化建设的完善。但通过文献检索发现：国内学者对体育社团的研究主要集中在体育社团概念、组织与分类的讨论，体育社团的经济因素分析，体育社团与政府的互动，以及体育社团涉及的法律纠纷等方面。然而我国关于体育社团法治方面的理论研究还比较分散，缺乏整体、系统的全面研究，体育社团的法律体系还不完善；体育社团在立法、司法和监督方面还有待改进，这些问题都在很大程度上制约了我国体育社团的可持续发展。为此，本研究在占有大量文献资料和调查研究的基础上，运用文献资料法、调查问卷法、专家访谈法、数理统计等方法对中国体育社团管理法治化的建设问题进行了研究，主要得出以下结论：1．中国体育社团管理法治化建设可以整合社会中的不同利益、意志和诉求，使中国体育社团适应现代市场经济法治化的要求，实现其健康、良性的运转，满足人们对和谐社会体育的要求。2．中国体育社团在我国经历了发展、消寂、复兴的演变过程，中国的体育社团数量不断壮大，体育社团的社会化进程不断加快，体育社团管理逐步走向规范化和法治化。3．我国的体育社团的管理体制尚不健全，体育社团法规体系还不完善，体育行政监督机制运行不畅，体育社团管理人员的理论水平偏低，体育社团的法治环境不理想等，这些问题充分反映出我国体育社团管理的法治化建设的迫切性和重要性。4．传统管理方式及陈旧价值观念的束缚，制约了我国体育社团管理法治化过程中人们对正当利益的选择，现阶段的政治经济体制、社会科技发展、法律法规的完善程度以及人们的文化知识水平，也都对中国体育社团管理的法治化产生着重要的影响。表明我国体育社团管理的法治化建设任重而道远。5．我国体育社团管理的立法，应提高立法层次，制定与宪法相衔接的体育社团法；建立与体育社团法律相衔接的实施细则和单行法规；建立与体育社团法规相衔接的体育社团工作章程与制度。建议出台“体育社团法”，以完善我国体育社团管理的法规体系。6．我国体育社团的司法，应建立针对体育社团的司法救济机制，规范体育社团行使处罚权的程序，以增强体育社团纠纷司法介入及仲裁的公正性。7．我国体育社团管理的监督，应顺应市场化潮流，以市场化的手段构建体育社团监督体系，突出和强化体育社团的社会监督，实现体育社团社会监督的制度化。更多还原

【Abstract】 The reform of sports system, a key for China’s sports reform, is crucially influenced by sports socialization. Thanks to sports socialization, sports community has taken on a flourishing situation in China in the recent years. However, the experience of sports community management is imperfect in that we are undergoing a period of social transformation where the management system of social sports is incomplete and the sports community in its modern sense lags behind in its way of development. Therefore, the perfectness of the legal system construction of China’s sports community management can guarantee the healthy and orderly development of the sports community. Despite that, it has been proved by data that China’s sports community needs to be improved in fields of legislation, judicature and supervision, and that the legal system of the sports community is to be perfected, and that there is an inharmonious relationship within the sports community. Moreover, besides its concept, organization and classification, the domestic studies on the sports community mainly concentrate on the economic funds, the political interaction with the government and the legal disputes etc. As can be obviously seen, there is a lack of systematic study on the legal system construction of China’s sports community management, which may to a great degree hinder the sustainable development of China’s sports community. Thus this thesis, aided by the abundant data and the actual investigation, carries out a study on the legal system construction of China’s sports community management by means of literature review, questionnaire, expert interview and mathematical statistics. Conclusions are as follows:1 The construction should take different interests and appeals into account so as to make the sports community develop in a sound way by adapting itself to the legal system of the modern market economy, thus harmoniously meeting people’s needs for social sports.2 China’s sports community has undergone the process of development, vanishment and renaissance. The number of the community is increasingly enlarged and the socialization of sports community is increasingly accelerated. As a result, the sports community management is gradually standardized and legalized.3 There are still a great many disadvantages in China’s sports community. For instance, the management system is still not sound; the law system is not complete; the mechanism of execution and supervision is not working well; the theoretical level of the management staff is relatively low; and the legal environment is not ideal. All these disadvantages indicate that there is an urgent need for the legal system construction of China’s sports community management.4 Choices for the sound benefits are greatly obstructed by the traditional way of management and the old-fashioned concept of value in the process of the construction of the legal system of China’s sports community. Meanwhile, the current political and economical system, technology, the degree of perfectnes of laws and regulations and people’s knowledge all exert a great impact on the construction of the law system.5 The level of legislation concerning the sports community management should be highly elevated. To put it exactly, setting up the law of sports community directed by the constitution; setting up the detailed rules for implementation and the single-line law related to the law of sports community and the working rules as well. "The Law of Sports Community" is strongly proposed to complete the legal system of China’s sports community management.6 For the perfection of the judicatory of China’s sports community, a judicial rescue system should be founded, and the procedure in its execution of the rights of punishment should be standardized so as to strengthen the justness of the judicial intervention and mediation in case there were some dissensions.7. The supervision over the sports community management should follow the market, constructing a direct system by way of market popularization and giving prominence to its social supervision.
