【摘要】 矿藏资源是人类赖以生存和发展的生产资料和生活资料的重要来源，是一个国家和地区经济和社会发展的重要物质基础。陕西省是我国的矿产资源大省，陕西省矿产资源开发利用对我国和陕西省的经济社会发展做出了重要贡献。但是在陕西省矿产资源开发利用过程中还存在着许多问题和不足，其走的仍是一种不可持续的老路；陕西省矿产资源法律体系也存在着许多问题和不足，已经不能适应社会发展的需要。在构建社会主义和谐社会的背景下，以可持续发展思想和发展科学发展观为指导，对陕西省矿产资源法律体系进行修订和完善显得极为紧迫和必要。在对陕西省具有代表性矿山和相关企业、政府机构进行实地调查研究的基础上，本文考察了陕西省现行矿产资源的法律体系，分析了其中存在的问题，采用理论联系实际和实证分析的方法，综合运用多学科知识对陕西省矿产资源法律体系的完善进行研究。本文分析了陕西省矿产资源开发利用现状及存在的问题，运用归纳、演绎方法梳理了陕西省矿产资源法律体系，指出了其中存在的一些问题和不足。从理论和实践等方面论述了通过完善立法来实现陕西省矿产资源可持续开发利用的必要性和可行性。指出陕西省矿产资源立法必须坚持以可持续发展思想为立法理念，以科学发展观为立法指导思想，坚持从实际出发，体现陕西特色、具有高度的可操作性、以人为本、综合开发与环境保护的立法指导原则。完善的陕西省矿产资源法律体系必须包含矿业权制度、矿业循环经济制度、规划制度、安全生产制度、综合开发利用制度、环境保护制度等，提出了陕西省矿产资源开发利用应在实施这些制度的基础上发展矿业循环经济的新思路。必须从中央立法和陕西省地方立法两个方面优化管理、修订现有立法、制定新的相关法律法规，从而完善陕西省矿产资源立法体系，保障陕西省矿产资源的可持续开发利用。更多还原

【Abstract】 Mineral resources are a major source of production and materials for human subsistence and serves as a cornerstone of economic and social development. Shaanxi Province is rich in mineral resources; whose exploration and utilizing have contributed a lot to its economic and social development. However, many problems and inadequacies exist in the process of exploration and utilizing, and the existing legal framework on mineral resources of Shaanxi Province, which goes against social development. In the context of building a socialist harmonious society and with the guidance of the thought of sustainable development and the view of scientific development, it is essential and urgent to revise and improve the legal framework of mineral resources of Shaanxi Province.Based on the field investigation of representative mines, enterprises and government agencies, the author reviewed the existing legal framework on mineral resources of Shaanxi Province, analyzed the problems and came up with solutions to improving the legal framework with the integrated manner of theory and practice, empirical analysis and comprehensive using of multidisciplinary knowledge.Analyzing the problems and inadequacies existing in the process of exploration and utilizing, and combing the existing legal framework on mineral resources of Shaanxi Province, the author both in theory and practice pointed out the necessity and feasibility of exploring and utilizing mineral resources of Shaanxi Province through improving the legislation. He also recommended that legislation on mineral resources of Shaanxi Province stick to the thought of sustainable development, the guidance of scientific development and implementing from its real situation. At the same time, legislation should feature the guiding principles of local characteristics, high feasibility, human-orientation, comprehensive exploration and environmental protection. Improving the legislation should also involve systems of mine ownership, circular economy of mine, planning, safe production, comprehensive development and environmental protection. The new way to explore and utilizing mineral resources of Shaanxi Province came into being—dual optimization management of central and local legislation should be enhanced; the existing laws and regulations should be revised; new laws and regulations should be enacted with a view to perfecting the legal system on mineral resources of Shaanxi Province and thus guarantee the sustainable exploration and utilizing of its mineral resources.更多还原
