【摘要】 近年来，商业贿赂在一些行业和领域盛行，腐败行为和经济犯罪滋生，这严重地损害了国家利益和人民群众的切身利益。为使我国经济远离商业贿赂，构建公平有序的市场经济秩序，中央在2006年对商业贿赂进行了专项整治，把反商业贿赂作为2006年反腐败工作的重点。全国人大常委会通过的《中华人民共和国刑法修正案(六)》第7条、第8条对相关刑事立法进行了重要修改补充。本文从商业贿赂犯罪的本体界定、构成要件、认定、立法完善四个方面对商业贿赂犯罪进行分析，以对商业贿赂犯罪有一个清楚的认识，从而有力地打击商业贿赂犯罪。本文由四个部分组成：第一部分介绍商业贿赂犯罪的本体界定。通过对贿赂与商业贿赂的介绍，明确了商业贿赂犯罪的概念及存在范围，对商业贿赂犯罪有一个初步的认识。第二部分介绍了商业贿赂犯罪的构成要件。从商业贿赂犯罪的客观方面、主体、主观方面、客体四个方面对商业贿赂犯罪的构成进行分析，从而对商业贿赂犯罪有一个清楚的认识。第三部分介绍了商业贿赂犯罪的认定。从商业贿赂犯罪罪与非罪的界定，既遂标准及共犯形态对如何认定商业贿赂犯罪有一个更深的认识。第四部分介绍商业贿赂犯罪的立法完善。从国外刑事立法关于商业贿赂犯罪的规定及以《联合国反腐败公约》为视角来了解国外的立法，进一步完善我国对商业贿赂犯罪的立法。更多还原

【Abstract】 In recent years, commercial bribery rampants in some industries and fields, breeding corruption and economic crimes. This has seriously damaged the interests of the country and people. To make our economy away from commercial bribery, and establishing a fair and orderly market economic order, the government developed special anti-commercial bribery and anti-corruption work as the key work in 2006. NPC Standing Committee adopted the "PRC Criminal Law Amendment (6)," Article 7, Article 8 of the important amendments and supplements to the relevant criminal legislation. The article analyses the definition, the elements, the identification and the Legislation of commercial bribery, then we can have a clear understanding of commercial bribery, what’s more, effectively combat commercial bribery.This paper consists of four parts:The first part introduces the definition and the existing condition of commercial bribery, and then we can have a preliminary understanding of commercial bribery.The second part gives an account of the conditions that constitute commercial bribery. The author analyses the necessary elements in four aspects. Then we can have a clear understanding of commercial bribery.The third part explores what is criminal and how to identify a completed commercial bribery. Then we can a deeper understanding of commercial bribery.Part IV introduces legislation to improve commercial bribery. After studying foreign criminal legislation and the provisions of the "United Nations Convention against Corruption", we should further improve our commercial bribery legislation.更多还原
