【摘要】 中国共产党在十六大上明确提出“坚持依法执政，实施党对国家和社会的领导”，这是党首次提出“依法执政”的概念；十六届四中全会又进一步把依法执政作为提高党的执政能力的重要目标之一。依法执政方式的确立，标志着中国共产党执政理论的科学化、系统化，是马克思主义政党对执政规律认识深化的结果。依法执政是加强党的执政能力建设的基本途径，是党在新时期执政方式的科学选择。党的执政方式转向依法执政，有利于巩固党的执政地位，夯实党的执政基础；有利于处理党与国家政权机关的关系，提高执政效率；有利于实现“三个代表”重要思想，保持党的先进性；有利于优化党的执政环境，提高党的执政能力。本文对依法执政的涵义及其相关概念进行了界定，对党的依法执政方式进行了历史回顾，并从中总结出经验和教训。在历史分析的基础上进一步阐述了依法执政是中国共产党在新时期执政方式的科学选择。本文最后对如何加强和完善依法执政问题进行了思考，对党依法执政过程中如何处理好党与人民群众、党与法、党的政策与法律以及执政党与国家政权等的关系问题进行了探讨。整个分析围绕着新时期党的依法执政方式的确立与完善来展开，由四个步骤组成。第一步是对执政、执政方式以及依法执政的概念进行界定，对学术界关于这些概念的不同观点进行综合，并对影响党的执政方式的主要因素进行归纳。党的执政方式受不同时期党的执政任务、社会环境、政治体制和文化等多种因素的影响。第二步是对党在不同历史时期的执政方式的实践进行回顾。中国共产党在新民主主义革命时期就对依法执政方式进行了初步探索。从新中国建立到“文革”前，党的执政方式经历了从以政策为主到以政策和法律并重的转变。在“文革”十年中，党的依法执政遭遇严重挫折。党的十一届三中全会以后，中国进入了新的历史时期，党的执政方式不断向法治方向转变。根据国内政治、经济、社会发展需要，党适时提出了“依法治国”的战略并将其载入宪法，党的十六大明确提出“坚持依法执政”，这是党在历经执政实践后对执政方式作出的重大转换。第三步阐述了依法执政是新时期党执政方式的科学选择。依法执政是新时期发展民主政治、建设社会主义法治国家的政治发展目标的核心环节，是社会主义市场经济发展的必然要求，是构建社会主义和谐社会的客观要求，是中国共产党总结世界各国政党执政经验和教训的结果。依法执政方式的选择是中国共产党与时俱进、不断开拓创新、富有活力的体现。第四步对新时期党依法执政方式的不断完善以及制度建设进行思考。党怎样执政、怎样完善党的执政方式是党执好政的关键。论文针对新时期党执政存在的主要问题，深入分析了党执政过程中如何处理好执政党与国家政权、党与人民群众、党与法以及党的政策与法律等的关系。党对国家政权机关的领导主要是政治领导、思想领导和组织领导，通过选派自己的代表按法定程序进入国家权力系统，掌握政权，发挥政治影响。“立党为公、执政为民”是党执政的基本要求。司法独立原则是处理好党与法律关系的重点。执政党政策的法律化是政治文明对执政党执政行为的具体要求。更多还原

【Abstract】 The Chinese Communist Party has putted forward the goal on 16th National Congress, which is "being in power by law and carrying out leadership to country and society ". The Chinese Communist Party has putted forward "being in power by law "on the fourth congress of 16th National Congress, which is the basic means to enhance governing by the Party. In other words, the ruling style of the Party has changed to being in power by law .The great breakthrough in theory of holding power of the Chinese Communist Party is standing for "being in power by law". This theory is scientific and systematic, which helps to deepen understanding for the regulation pattern of governing. The change helps to strengthen ruling status of the Party and solidify the ruling base of the Party. Being in power by law benefits to deal with the concern of the Party and make people well practice the thought of "three representatives ". In order to raise ability of holding power, the Chinese Communist Party must be ruling in power by law, which is the requirement of the times and the development in China. The paper analyzes the ruling style of the Chinese Communist Party in new period. The whole analysis will be carried out by four steps in accordance with the change of ruling style of the Party.In first step (chapter one), the paper explains the conceptions of holding power and ruling style of the Party. Based on the analysis, the paper discusses the factors, which affect the ruling style of the Party. The factors mainly include the different ruling tasks in different period, societal environment, political system and political culture.We follow the second step (chapter two) to review the history of the ruling style of the Chinese Communist Party. The Chinese Communist Party initially explored the ruling style in the new democratic revolution. From the founding of new country to "culture revolution ", the ruling style of the Party changed from policy to lay equal stress on policy and law .In period of "culture revolution ", legal system had destroyed .The third congress of the 11th National Congress of the Chinese Communist Party is the new starting, that the Chinese Communist Party handles affaires according to law. After the year of 1978, the legal systems have built in China. The Chinese Communist Party has putted forward the rule of "running the country according to law ", which has been written into the constitution of People’s Republic of China. The 16th National Congress of Chinese Communist Party putted forward "being in power by law". It is the great breakthrough in the practice of ruling in power.With the third step (chapter three), the paper analyzes the regular pattern that "being in power by law" becomes a certain selection of the ruling style of the Party. Being in power by law is an important way to develop democracy and construct the socialism country .In order to develop socialism market economy; we must carry out "being in power by law". The reason is that socialism market economy is economy by law. "Being in power by law" is also the basic requirement of establishing harmonious society. The harmonious society is a fair, reasonable and ordered society, in which the development of people is full, coordinate and continual. Carrying out "being in power by law" is a summary of experience and lesson from the Party of socialism country and developed country.With the fourth step (chapter four), the paper discusses how to construct the perfect system of ruling style by law of the Chinese Communist Party in new period. It is necessary to deal with some relations, such as the relation between Party in power and people, the relation between Party in power and law, and the relation between Party in power and state power. This chapter deeply analyzes the problems of ruling in power in new period, and putts forward some proposes to build the perfect ruling style of the Party. The Chinese Communist Party must establish Party for the public, and rule in power for people, which is the basic requirement for the Party. The relation between Party in power and law ought to be relatively independence. Being in power by law not only is the basic constitutional request to the incumbent Party, but also must be the ruling style of the Chinese Communist Party in new period.更多还原
