毒品犯罪若干问题研究

【摘要】 毒品问题不仅诱发大量的违法犯罪活动，严重影响社会稳定，而且往往与国际恐怖势力、黑社会组织、腐败问题、洗钱犯罪等联系在一起，严重危害国家的安全和和谐社会的构建，已成为世界范围内的一大社会公害。长期以来，虽然我国政府以对国家、民族、人民和全人类高度负责的态度，坚持严厉禁毒的立场，为禁绝毒品投入大量人力物力，做出了不懈努力，但受毒品问题全球化和国际毒潮泛滥的影响，近些年来我国毒品消费市场持续扩大，毒品滥用种类越来越多，毒品问题呈蔓延之势，危害日趋严重。由于禁毒机构不健全，禁毒立法滞后，导致对毒品犯罪打击不力。加强禁毒执法工作，依法严厉打击毒品犯罪活动，是综合解决我国毒品问题的首要环节。禁毒部门应根据我国毒品犯罪活动的现状和特点，有针对性地开展禁毒斗争。本文通过对当前我国毒品犯罪形势日益严峻的原因和毒品犯罪的特点进行分析、研究，探讨打击毒品犯罪中的有关疑难问题，提出打击毒品犯罪对策。全文除引言和结论外，共分四个部分：第一部分，毒品犯罪概念及其特点。一是介绍世界卫生组织对毒品下的定义，分析毒品与药物及毒物之间的联系。认为毒品是指被非法使用的、能够使人形成瘾癖的、国家规定管制的麻醉药品和精神药品。指出我国对毒品管制范围的变化，分析毒品具有的依赖性、危害性、违法性和价值特征，对毒品进行分类。二是总结刑法学界对毒品犯罪定义的几种观点，说明自己的看法，对毒品犯罪进行分类。三是从人的方面、地域方面、时间方面、证据方面、采取的方法、手段等五个方面分析了毒品犯罪不同于一般刑事犯罪的特点。第二部分，毒品犯罪现状及其原因。一是分析当前国际毒品问题的突出特点及其原因。二是分析我国当前的毒品形势及原因。指出由于受国际毒潮泛滥和国内涉毒因素的影响，当前毒品问题发展蔓延的总体趋势尚未得到根本扭转，禁毒工作形势仍非常严峻，任务依然繁重。首先从国际因素，接着重点从历史因素、现实因素、思想根源、文化因素、经济因素、禁毒法制建设和禁毒机构、禁毒工作现状、毒品本身所具有的强烈诱惑性、对毒品犯罪的打击程度方面分析我国毒品问题死灰复燃并日趋泛滥的国内原因。第三部分，打击毒品犯罪中的疑难问题。一是对如何认定毒品犯罪中的明知提出自己的看法。二是分析贩卖、运输毒品罪和非法持有毒品罪的界限。三是对毒品犯罪数量与量刑标准问题从八个方面进行分析探讨。第四部分，打击毒品犯罪的对策。结合我国毒情和禁毒斗争实际，提出了四个方面的打击对策。一是完善禁毒立法。二是加强禁毒执法。三是综合治毒。四是加强禁毒国际合作。更多还原

【Abstract】 Narcotic problem not only induces massive illegal and criminal activities affecting the social stability seriously, but also is often linked with international terrorist group, organized crime organization, problem of corruption, and money laundering crime, etc. It severely impair our country’s security and construction of harmonious society, and has become a big public hazard in the world. For a long time, with a highly responsible attitude to our country, nation, people and the world, Chinese government adheres to the standpoint of suppressing drug severely, and has made unremitting efforts in banning narcotic by investing massive human and material resources on it. Influenced by international narcotic flooding and domestic drug-relating elements, narcotic consuming market has been expanding continuously in our country, and more and more kinds of drugs have been abused. The problem of narcotic has emerged the trend of expansion, and its harm has become more and more serious. Because the drug banning institutions is not complete, and drug banning legislation lag behind, the attack on narcotic crime is not effective. The first important step in comprehensively resolving our country’s narcotic problem is to strengthen the enforcement of drug banning law and to attack drug-related crime severely by law. Narcotic banning institutions should suppress the drug-related crime based on the status quo and characteristic of our country’s drug crime activities. Through analyzing and studying the reason leading to the more serious situation of narcotic crime and the characteristic of narcotic crime, this paper probes the knotty problems in attacking narcotic crimes and proposes the countermeasure on narcotic crimes. Besides the introduction and the conclusion, the full text is divided into four parts. The first part is on concept and characteristic of narcotic crimes. Firstly it introduces the definition of narcotic given by .World Health Organization, and analyses the relation among narcotic, medicine and poison. Narcotic refers to the addictive narcotic and spiritual medicine that is regulated by legislation but illegally used. The paper points out the change of our country’s controlling scope on narcotic, analyzes narcotic addictive, hazardous, illegal and valuable nature, and makes the classification of narcotic. Secondly through summarizing the views on the definition of narcotic crimes in criminal law field, the writer explains his own view, and makes the classification ofnarcotic crime. Thirdly the paper analyzes the characteristic of narcotic crime different from that of the general criminal offenses in the respect of human, region, time, evidence and way or means adopted. The second part is on the status quo and reason of narcotic crimes. Firstly it analyzes the outstanding characteristic and reason of the recent international narcotic problem. Secondly it analyzes the recent situation and reason of narcotic in our country. It points out that because of the influence of international narcotic flooding and domestic drug-relating elements, the general trend of the development of narcotic problem has not been changed fundamentally. The situation of banning narcotic is still serious, and the task is still hard. This paper analyzes the reason that narcotic problem emerge again and run wild in China from the point of the world, history, reality, ideology, culture, economy, legal system on drug banning, drug banning institution, work of drug banning, strong addiction of the drug, and the attack on narcotic crime, etc. The third part is on the knotty problem in attacking narcotic crime. Firstly the writer explains his own view on how to confirm consciousness in narcotic crime. Secondly the paper analyzes the difference among the crime of selling, transporting and illegally holding narcotic. Thirdly the paper studies the quantity of narcotic crime and measurement of penalty from eight points. The fourth part is on the countermeasure of narcotic crime. The author points out four countermeasures on narcotic crime based on the situation of drug crime in China and the reality of drug banning. Firstly it is to perfect the legislation on drug banning; secondly it is to strengthen the enforcement of law on drug banning; thirdly it is to implement comprehensive administration; and fourthly it is to promote international cooperation on drug banning.更多还原
