【摘要】 随着我国依法治国方略的实施，行政法律调整范围的扩大，行政违法案件日益增多，而其中相当一部分违法案件事实清楚、简单，对此设立简易程序，由执法人员当场作出处罚决定，不仅有利于及时处理问题，提高行政效率，客观上也便利了被处罚人。但是，我国目前的行政处罚简易程序还很不完善，缺乏制约，不仅很容易侵害当事人的合法权益，也给行政机关的执法带来不便。因此，本文选择此问题作为研究方向，对行政处罚简易程序的基本涵义作了总体上的介绍之后，对行政处罚简易程序与行政处罚一般程序进行比较，突出表明行政处罚简易程序的特点及优点。然后，从法理学的角度对行政处罚简易程序的价值理念进行阐述，为后面分析提供理论上的支持。最后，对我国行政处罚简易程序中存在的问题进行归纳和分析，以找出症结所在，并对我国行政处罚简易程序中存在的各种问题，给出解决方案，意在使其最终能更好的指导实践。更多还原

【Abstract】 The administrative penalty takes that administration there exists in people’s illegal activities relatively as premise, administration illegal activities firm belief and making that the administrative penalty decides are dependent on certain administrative penalty procedure.
