【摘要】 仓单质押是现代物流业务的新发展,同时也可被看作一种金融产品,它是一种衔接物流与金融领域的业务。仓单质押贷款可以较好地解决我国目前信用体系不健全的问题,能够有效地缓解银行和企业之间的矛盾,是企业与银行之间融通资金的重要手段。每种业务的开展均是风险和利益共存,仓单质押也不例外。仓单质押业务在我国尚处于起步阶段,因此对其进行风险管理研究具有借鉴意义。本文首先介绍了仓单质押的内涵及在我国开展仓单质押业务的几种模式和存在的风险,然后将风险分类为管理风险、金融风险、法律风险分别进行研究,同时针对每种风险,提出了详细的规避措施。在管理风险研究中,本文根据仓单质押业务的操作流程进行风险分析并提出相应规避措施;在金融风险研究中,将金融风险分为银行所面临的企业经营风险和道德风险,并运用博弈论和对策论的方法对两种风险进行分析。在这部分的研究中,仓单质押贷款质押率的确定是本文的一个创新点,但研究也还不完善;在法律风险研究中,本文深入研究我国涉及仓单质押的所有法律条款,对从仓单质押的合法性到仓单质押的实行进行了一系列的分析,最后提出了如何避免法律漏洞对仓单质押的开展造成影响的建议。更多还原

【Abstract】 Warehouse receipt pledging is a list of new business development of modern logistics, and it can also be seen as a financial product. It is a convergence of the fields of logistics and financial operations. Warehouse receipt pledging can be used to solve the current problem of an unsound credit system. It becomes an important means of pooling funds between banks and enterprises.Each business including warehouse receipt pledging has both risks and benefits. This business is still at the initial stage in China, therefore the risk research on it can be used for reference. Firstly, this paper introduced the connotation of warehouse receipt pledging and the risks of every model. Then the paper classified risks into management risks, financial risks, and legal risks and studied them separately. Also, the paper presented detailed measures to avoid each risk.In the research of management risks, the paper analyzed the risks based on the operating procedures and raised corresponding measures to avoid. In the research of financial risks, financial risks were divided into business risk and the moral risk which were both confronted by banks. The paper analyzed the two risks by the method of Game Theory. In this section, to make certain the pledging rate is an innovation, but the method of it is not consummate. In the research of legal risks, the paper studied all of the legal items about warehouse receipt pledging and analyzed them. Finally, the paper advised how to avoid the pact of legal loopholes.更多还原
