【摘要】 随着社会经济的发展，国家进行了大规模的基础设施建设，不可避免地造成大量的农村征地移民。在移民安置过程中，广大受影响移民应该享有充分的参与权，但由于在农村征地移民过程中参与机制不健全，相关法律法规不完善，移民参与的总体水平较低，移民贫困现象不断发生；造成了移民和其他利益相关者之间许多冲突。针对目前国内征地移民参与现状，有必要对移民安置工作过程中移民的有序参与作明确的程序设定。 首先在阅读大量工程移民相关文献资料的基础上，对国内外相关研究进行了梳理；总结出与征地移民相关的利益相关者理论与博弈理论；以及法律依据，如征用土地公告办法，国土资源听证规定等。其次，在此基础上分析农村征地移民参与的现状，找出影响移民参与的主客观原因：主观因素有移民的搭便车心理、从众心理；组织能力、移民认同程度、需求层次差异等，客观因素有政治环境、经济环境、参与成本、社会文化环境、教育程度等因素；再次，提出了以农村征地移民安置项目周期为基础的移民参与框架；最后明确提在移民参与的不同阶段中的参与的方式、方法和内容，并给出农村征地移民参与的实现途径。力求为移民参与提供详实的参考，保证移民的参与的合法权力，减轻征地移民参与工作中的盲目性和不合理性、提高预见性和科学性。更多还原

【Abstract】 The development of state goes with the establishment of infrastructures and a lot of farmers were affected by resettlement. During resettlement, resettlers should have participation rights, but because of lack participation system and faulty laws and regulations, they owned low participation level. The poverty caused by resettlement made conflict between stakeholders. Effective and full participation to resettlement can help the plans and policies go smoothly and also help resettlers restore their lives as soon as possible.Firstly, based on the materials on resettlement and land acquisition, related research achievements were collected and analyzed, and then the theories and laws and regulations on resettlement and land acquisition were also concluded, including stakeholders and game theory; Measures on Land Acquisition Notice, Regulation on Hearing of National Land Recourses etc.; secondly, the factors affect resettlers participation were found according to present resettler participation situation, such as hitchhiker, conformity and organization ability, self-identity sense, requirement level, political, economy and cultural environment, participation cost, education etc; Thirdly, resettler participation framework was set up; at last various activities or resettlement, methods, contents in different stages were given to make sure the approach of participation. It can provide information for references in further studying the subject of public participation. By this, blindness and irrationality in resettlement would be reduced and prediction and scientificity would be increased.更多还原
