【摘要】 我国的人口和计划生育工作取得了举世瞩目的成就,但是随着社会主义市场经济和基层民主政治的发展,原来以行政干预为主推行计划生育的管理体制和工作机制已经难以为继,在以人为本原则和实现人的全面发展目标下,与村民自治的基层农村管理体制改革相配合,计划生育纳入村民自治轨道将成为必然。本文在理论探讨和实践验证的基础上,运用比较分析、实证分析等方法,结合新公共管理及制度变迁相关理论,得出计划生育村民自治是制度变迁的结果,它将逐渐作为一种制度安排确立下来的结论。这种制度变迁的环境是中国民主政治的进一步发展,产生机理属于政府主导下诱致性制度变迁和村民需求下强制性制度变迁相结合的“二元模式”,变迁路径为“渐进式制度变迁”。本文对计划生育村民自治的概念作了新的诠释,指出计划生育村民自治模式的显著特点就是强调社会参与特别是村民群众广泛的民主参与,使计划生育工作由过去单纯依靠行政机关的管理模式变为以广大村民群众为主体,各自治体包括村民个体广泛参与的新模式。并且分析了计划生育村民自治与村民自治的关系,研究了计划生育村民自治的运行环境、工作流程和效果评价方法,从社会和法律的视角探讨了计划生育村民自治条件下基层政府职能和行为方式的转变,提出计划生育村民自治制度确立和运行后,政府必须转变工作方式方法,对计划生育村民自治给予指导、支持和帮助的建议,对政府在人口和计划生育方面的职能定位,则可以概括为“依法管理、优质服务、政策推动、综合治理、支持帮助、考核指导”。本文还提出了政府指导计划生育村民自治与计划生育村民自治协助政府的双向互动体制,分析了计划生育协会这一非政府组织在计划生育村民自治中的地位和所发挥的骨干作用,并展望了中国计划生育村民自治的发展将最终向“家庭发展计划”模式演变的总体趋势。更多还原

【Abstract】 We have made great progress on population and family planning conditions of China. However, the managerial system featured with the administrative intervention can not be practiced as the socialist market economy and the grass root democracy is developing. Aiming to realize the people’s integrated development, matching with the reformation on grass root country management system, the villagers’ self–government on the family planning will be necessary.Connecting with the new theory on public administration and institutional change at the base of theoretic and practice, by comparative analysis and demonstration analysis, the article deems that the villagers’ self–government on the family planning is the result of the institutional change and will be radicated as a rule. The democracy in China is developing, while imposed institutional change caused by government domination and induced institutional change caused by villager requirement form a duality mode which leads to the whirligig changing in a gradual way.A new definition for villagers’ self–government system on the family planning is given in the article, emphasizing the concern from the society especially the villagers, which can lead the way from the management of administration to the participation of the autonomies especially the villagers. The relationship between the villagers’ self–government on the family planning and the villagers’ self-government itself is analyzed, while the conditions, the flow of work and the effect evaluating method are studied.Discussed from the view angle of the society and law, the article gives the suggestion that the function of the government must be changed into guiding, supporting and helping while the villagers’ self-government on the family planning is practiced, which can be summarized into“Manage with Law, Service with Heart and Prompt with politics for Guide, Support and Help”. The bidirectional interaction system built by the guiding from the government and the assisting from the villagers’ self-government is suggested. The family planning association which is non-government organization can be the backbone in the villagers’ self–government system on the family planning. It is supposed that the villagers’ self–government system on the family planning will finally develop to be Family Self-determination mode.更多还原
