【摘要】 近年来,随着我国房地产业的迅速发展,居民对于住宅质量问题的意见和矛盾也较为集中,住房屋顶开裂、墙皮脱落以及楼面、水管、卫生间漏水甚至房屋倾斜倒塌等现象给人民生活带来诸多不便,造成严重的社会后果。在我国传统的住宅质量保证机制下,住宅质量问题没有得到有效解决,损害了消费者利益,影响了社会稳定。住宅质量问题已成为全社会关注的焦点,呈现出投诉多、涉及面广、金额大、增长快、解决率低下的特点。因此,完善我国住宅质量保证机制,解决住宅质量问题,是必要的举措。本文运用制度变迁理论、信息经济学、新制度经济学等现代方法,立足于我国基本国情和建筑市场改革方向,借鉴国外市场经济发达国家住宅质量保证保险实施经验,剖析了我国当前住宅质量问题无法有效解决的根源,提出了建立我国住宅质量保证保险机制的基本框架和基本体系,并对其运作模式进行了理论分析,提出了完善我国住宅质量保证机制的配套环境设计。本文的主要内容包括以下几个方面:(1)通过国内外住宅质量保证机制的对比分析,归纳总结我国住宅质量问题产生的根源并提出了改革的方向;(2)在借鉴法国住宅质量保证保险实施经验的基础上,构建了我国住宅质量保证保险体系,探索了住宅质量保险制度下质量保证机制的运行模式;(3)对质量检查中介机构、保险公司运作模式、费率厘定等进行了探讨;(4)从制度经济学角度对我国住宅质量保证保险的建立进行了理论分析;(5)从建立信用评价体系、住宅质量性能认定、信息披露制度、完善保险品种等多角度,提出了完善我国住宅质量保证保险机制的配套环境设计。更多还原

【Abstract】 In recent years, along with the quick development of our country’s real estate industry, the residents also compare for the concentration to opinion and antinomies of the housing quantity problem, such as the housing roof crazing , the wall skin shedding off and the floor, the pipe line leaking , even the house tilting or collapse , resulting in serious social result. Under the our country traditional residence quality control mechanism, the residence quantity problem did not get to resolve effectively, injuring the consumers’benefits and affecting the society stability. The residence quantity problem has become the focus of whole social concerns. Therefore, perfectinh our country’s residence quality control mechanism, resolving the residence quantity problem, is necessary .This paper makes use of the modern methods such as the information economics and system change economics...etc., having a foothold in the situation of our country and construction marketing reform direction, drawing lessons from the international implement experience on inherent defect insurance , analyzing the problem on current residence quantity in our country. The paper puts forward the basic frame and system establishing our country’s residence quality control insurance mechanism. It also puts forward the the environment design perfecting our country’s residence quality control mechanism.The textual main contents includes a few aspectses as follows:(1)Passing the contrast of the domestic and international residence quality control mechanism, conclude the reason creating residence quantity problem;(2) Drawing lessons from inherent defect insurance in French, set up our country’s residence quality controlling insurance system, and explore the movement mode of the quality control mechanism;(3)Discussing the operation mode of insurance agent , fee rating and so on;(4)Carried on the theories analysis to the establishment of the our country residence quality control insurance from angle of the system economics;(5) Putting forward the kit environment design perfecting our country’s residence quality controlling insurance mechanism.更多还原
