【摘要】 本文通过环境侵权及其民事责任概述、中外环境侵权民事责任的比较、环境侵权民事责任的归责原则、环境侵权民事责任的构成要件、环境侵权民事责任方式、完善我国环境侵权民事责任的基本思路等六个部分，对环境侵权民事责任进行了比较系统的分析和论述。 在环境侵权民事责任的研究中，首先应当明确环境侵权及其民事责任的概念和特征，并指出研究环境侵权民事责任的重要性，以及民法规范在保护环境中的重要作用，这是本文的研究基础和出发点。环境侵权民事责任作为特殊侵权的民事责任，在我国的远古时代就有萌芽并在我国当代有了一定的深入的研究。 本文通过比较中外环境侵权民事责任，分析我国环境侵权民事责任的特点和不足之处，指出我国应在环境民事诉讼中的诉讼主体资格、环境民事责任承担方式、因果关系推定上，需要借鉴国外经验的根本理由。 本文着重论述了环境侵权民事责任的环境侵权民事责任的归责原则和构成要件。通过分析环境侵权民事责任归责原则的发展，指出我国环境侵权民事责任归责原则存在的不足，建议完善无过错责任。提出我国环境侵权民事责任应坚持“三要件说”。在法律中应当明确规定举证责任转移和因果关系推定。环境侵权的抗辩事由中，应当将正当防卫和紧急避险规定在内。另外，将环境侵权民事责任方式从性质和作用上分成防止性责任方式、补偿性责任方式、处罚性责任方式进行讨论，从而防患于未然，更好地保护环境。更多还原

【Abstract】 There are six parts in this article. They are summary of environmental tort and civil liability comparison of civil liability of environmental tort in China and abroad ,doctrines of liability fixation in civil liability of environmental tort and perfecting the essential thoughts of civil liability of environmental tort in China. By these six parts , the theory of civil liability of environmental tort is analyzed and expounded systematically.During the research of civil liability of environmental tort , first it is necessary for us to know well the concepts and characteristics of environmental tort ,and civil liability , the importance of study of civil liability of environmental tort and the important role of civil law in environmental protection, which is the springboard and research basis of the essay. Civil liability of environment tort, which is the Civil liability of special tort, germinated in ancient times of China and has been researched deeply now .From the comparisons of civil liability’ of environmental tort in China and abroad , this essay focuses on the characteristics and disadvantages of civil liability of environmental tort in China and points out that it is necessary for us to learn from abroad in many ways such as the qualifications of litigate body, reasoning of cause and effect, manners of bearing of civil liability of environmental tort in environmental civil litigation.This essay focuses on the imputation principle and important factors of civil liability of environmental tort.
