【摘要】 听证制度是指国家机关作出决定之前，给利害关系人提供发表意见提出证据的机会，对特定事项进行质证、辩驳的程序，其实质是听取利害关系人的意见。听证在形式上有正式听证与非正式听证之分，听证的方式可以是口头的，也可以是书面的。广义上的听证包括立法、司法和行政听证三种形式。行政听证程序是现代民主政治的产物，作为公民参与行政的重要制度已成为当今世界法治各国行政程序法的核心内容。 随着决策科学化和民主化的发展，听证制度成为可以将民主与科学融入决策的最佳渠道。现代民主宪政的运作与发展，关键在于政治参与，民主政治从根本上就是民意政治，参与是民主政治的基石，民众的参与程度是衡量民主发展的标尺。而建立听证制度的最根本的目的之一就是赋予公民参与权与一定的参与决策权，同时听证制度成为民主参与的重要形式之一。通过听证获取信息，这些信息反馈至公共管理者或政府部门，为行政决策、立法、司法提供决策信息基础，不仅能提高公共决策的技术和水平，而且可以将各利益方的矛盾与冲突纳入秩序范围之内，促进政治沟通，消除政府、公民和其他利益团体的隔阂，缩短政府与公民之间的距离。 “话语权”代表着某种游戏规则。这个规则的实质就是指在社会上，谁有权说话，谁说的话能传达出去，谁说的话能起到作用。哈贝马斯提出“话语政治”，指的是对待社会协作的一种态度，一种开放的态度，它允许经过讨论接受他者和自己的要求。话语中介是平等的交换观点，包括参与者提及他们自己对于他们所尊重的利益的看法。而强势话语则严重侵害了普通公众的话语权，在听证制度中，均衡话语权成为实现听证重要功能不可忽视的方面。然而不可否认的是，均衡话语权的实现需要经历一个比较长期的过程，那么我们的当务之更多还原

【Abstract】 one of China’s important public policy-making reforms is the introduction of the public hearing system ,which has been adopted in the legislative and administrative sectors . Base on the analysis of the right to learn the truth and the right of the speaker’s words in process of public hearing system, this research aims at conducting a theoretical and empirical analysis on its functional goals and implementation in order to contribute to the better development of the system.We know that there are a few of people to attend the process of making and carrying out the public policy, so we create more possible to people at the beginning of one public policy. Public hearing is the fundamental method to practice the public’ s the right to learn the truth and the right of the speaker’s words. The result of the two rights will be enforce the atmosphere of democracy and also develop and integrity the public system. The right to learn the truth and the right of the speaker’s words are two pushing machines to push the public hearing system and create more chance and ways for public to attend the process of making and carry on the public policy.Base on the existing research on this issue in China and abroad, as well as China’s reality ,this research mainly focuses on the public hearing system in two field : public hearing in the prices of regulated products and services and xingFang process .The general framework of the research is "functional goals and institutional procedures".更多还原
