【摘要】 本硕士论文共分四章，每一章都由“引言”、“正文”和“本章小结”三部分构成。 第一章着重分析沉默权和拒绝自我归罪特权(又称反对自证其罪)之间的历史渊源以及二者的区别联系，辨析出沉默权的具体含义，确定出本文论述对象的内涵。文章首先谈论拒绝自我归罪特权的起源及内在含义，然后论述沉默权的起源和发展以及英国对沉默权的限制，最后将沉默权与拒绝自我归罪特权进行比较研究而得出结论。本章认为拒绝自我归罪特权和沉默权的思想均源于“任何人无义务控告自己”的法谚，不过沉默权这一权利本身更是来源于拒绝自我归罪特权这一概念，二者概念之间的逻辑关系为交叉关系，既联系紧密又相互独立。 第二章介绍了沉默权制度的规则内容，基本上是综合英美国家沉默权规定的结论性描述。总的来说，沉默权制度的规则内容包括沉默权的行使规则、沉默权的放弃规则以及沉默权的保障规则三个方面。本来对于诉讼制度内容的介绍应从制度的启动(适用范围)、运行、后果及救济三方面着手，但沉默权基于其生存的特殊性(沉默权本身对于刑事诉讼实体正义价值可能存在的极大损害及国家司法权力对沉默权的巨大威胁)，本文特将沉默权制度的保障规则单一例出，而且沉默权制度的运行也是依赖其保障规则的实施。由于硕士论文的篇幅所限，本文只论述犯罪嫌疑人、被告人的沉默权问题，并不涉及证人的沉默权。更多还原

【Abstract】 The essay has four chapters besides an introduction, and each of the chapters consists of an introduction of itself, the main part and a conclusion.In the first chapter, this essay pays much attention to the historical source of the right to silence and the privilege against self-incrimination as well as the differences between them, based upon which concludes the definition of the right to silence and defines the content of the object in this essay. In this chapter, it firstly discusses the origin and the content of the privilege against self-discrimination, and then explains the roots and development of the right to silence as well as the restriction of this right in U.K. Finally, this part would make its conclusion on the comparison between the right to silence and the privilege against self-incrimination. This chapter believes that both of the two rights stemmed from the adage that on one has the right to accuse himself. Nevertheless the right to silence in a degree comes from the privilege against self-incrimination, and the logical relationships between these two rights are intersected, overlapping and separating.In the second chapter, this essay presents the content of the right to silence through the comprehensive description of the right in Anglo-American countries.
