【摘要】 行政裁量权的扩大是社会发展的必然趋势。加强对行政裁量权的司法控制也就成为依法行政的必然要求。研究行政裁量权的不断扩大与对行政裁量权的控制不断加强的关系，始终是现代行政法学研究的一个重要课题。现阶段我国对行政裁量行为的司法审查采用的是合理性标准，但是这一标准有一定的缺陷，在我国并没有发挥出应有的作用。引入比例原则作为行政法的基本原则，并成为司法审查的标准之一，将会对我国的行政法治建设起到举足轻重的作用。 本文共分为三章。 第一章为比例原则之理论界定。本章首先以德国为蓝本对比例原则的概念以及内涵进行了阐述，并对其三个子原则：妥当性原则、必要性原则以及均衡原则的关系进行了比较。第二节阐释了比例原则的理念基础为基本权利观念、法治国家观念以及公平正义观念，比例原则能够得以巩固和发展是有其深厚的法学理念为基础的。第三节对比例原则的位阶及适用范围进行了论证，指出比例原则应为行政法的基本原则，适用于所有的行政行为。第四节将比例原则与普通法上的合理原则进行了比较，指出两者在属性上具有很大的差异，前者比后者更具体、更具操作性。最后指出了比例原则所具有的功能以及其存在的局限性。比例原则具有最大限度的保护公民的基本权利、为司法审查提供较具体的审查标准的功能，同时其在司法操作和保护功能上也具有主观性、弹性、概括性以及消极性的缺陷。 第二章为比例原则各国之司法审查适用。首先介绍了在大陆法系国家对行政裁量行为进行司法审查适用比例原则的情况，主要介绍了德国、法国、日本等国的比例原则司法审查的实践状况。随后指出虽然英美法系国家没有比例原更多还原

【Abstract】 The expansion of Administrative discretion is an inevitable trend of social development. Strengthening judicial control of administrative discretion will become law demands. Researches on expanding of the administrative discretion and strengthening of the control to administrative discretion has always been an important modern administrative law research topics. At this stage, our judicial review of administrative acts at the discretion uses the reasonableness standard, but this standard has a certain mistakes, and in our country does not play a proper role. Introduction of the principle of proportionality as the basic principles of administrative law, judicial review standards are becoming one of China’s administrative law and it will play a pivotal role in China administrative law construction.This article is divided into three parts.Part I is the theoretical definition to the principle of proportionality .Chapter I make the German blueprint for the concept and content of the principle of proportionality elaborated, and their three sons principles; the proper principle, the balanced principle and the principle of the need for a comparison of the relationship.
