【摘要】 不动产是一个国家和社会最重要的经济资源，不动产登记制度是保障不动产交易安全最基本的制度。我国市场经济刚刚起步，物权立法严重滞后，不动产登记制度还显幼稚。鉴于不动产登记制度在现代经济社会生活中的重要性以及当前我国不动产登记制度的立法现状，本文借鉴发达国家先进法律理论和成熟制度经验，结合本文作者五年的登记实践工作体会，就我国不动产登记制度相关疑难问题进行探讨，并就若干具体制度改革和完善提出个人建议。 本文第一章为不动产登记制度基本理论。本章共分三节，分别为不动产登记相关概念、不动产登记法理基础、不动产登记法律性质。本部分是不动产登记制度的基本知识。 本文第二章为国外不动产登记立法与理论反思。本章共三节，即不动产物权变动理论模式、不动产登记制度立法体例、物权变动模式与不动产登记制度的关联与协调。任何制度的建立和完善都离不开基础理论的指导和相关经验的借鉴，分析比较国外登记实践，可以为我国不动产登记制度的完善提供必要理论和制度“前见”。 本文第三章为中国不动产登记制度的历史与现状。本章共二节，即中国不动产登记制度历史沿革和中国现行不动产登记制度的缺陷与不足。通过对我国不动产登记历史回顾，分析现行制度的具体成因和体制缺陷，以期能针对性地提出改革建议，是为本章写作的目的。 本文第四章为中国现行理论与制度重构探讨。本章是本文重点，共分七节。 本章第一节着重论述我国不动产物权变动理论和不动产登记制度的选择依据。本文认为，由于我国现行登记制度与瑞士权利登记制最为接近，借鉴该模更多还原

【Abstract】 Real property is the most important of economic and social resources of a country and it’s the foundation of people’s survival and development . Therefore in the national security legislations of different countries, to ensure transaction security is regarded as a real focus without exception. Real property registration system is the most fundamental system in a variety of related systems. As our country is just beginning to develop the market economy, property rights legislation lagging seriously behind, real estate registration system is also a little naive. Therefore, how to build and improve our real estate registration system is a topic that not only has theoretical value but also has practical value.Take the importance of real estate registration system in the modern economic and social life and our current legislative situation system into consideration, the paper introduces the three main patterns of the transfer of real estate right of the world and their corresponding real estate registration systems. It also reviews the historical changes and discusses the existing features of our real estate registration system .It explores the relevant legal basis for real property registration system, and on this basis my paper conducts preliminary theoretical elaboration as to work out a few difficult problems which arises in the process of restructuring real property registration system .
