【摘要】 随着世界贸易和交通工具的迅猛发展,外来物种入侵活动口益加剧,外来物种入侵对我国的生物多样性和生态安全构成了巨大的威胁,给部分地区造成了巨大的经济损失。为了保护生态环境和生物多样性,保障我国的生态安全,实现物种资源的可持续利用,建立完善的控制外来物种的法律体系是十分紧迫而必要的。但是我国现行防治外来物种入侵法律还存在很多问题,并没有充分包含入侵物种对生物多样性或生态环境破坏的相关内容,与从保护生物多样性角度控制外来入侵物种的目标还相差甚远。我国应当在分析外来物种入侵现状的基础上,在立法原则的指导下,整合现有法律规定,建立我国防治外来物种入侵法律体系。“外来物种入侵法律制度研究”,对我国现有相关法律的立法目的和立法原则进行了重新审视,从法律制度的设计层面出发,对一套既适合我国国情同时又具备可操作性的防治外来物种入侵及外来物种管理法律制度提出若干设想,尝试解决相关法律制度不健全的问题,以实现保护生态环境和生物多样性,有效防止外来物种入侵的目标。本文共分四章进行论述:第一章对外来物种入侵的一些基本概念及基本情况进行了阐述;第二章介绍和分析了有关外来入侵物种的国际和国外立法动态;后面的两章是文章的主体,第三章对我国外来物种入侵的现状和相关的法律制度进行了分析,第四章对我国防治外来物种入侵提出了立法建议。更多还原

【Abstract】 Along with the influence of world economy, trade and communications development with high speed, alien species invading sharply day by day, has become one of key factor of imperiling biological diversity and ecological environment of our country and has caused great losses of ecology and economy. The invasion of alien species has constituted enormous threat to biodiversity and ecological security of country. For the protection of ecological environment and biodiversity, guarantee of the ecological security of our country and realization of the sustainable utilization of species resources, it is very urgent and essential to set up the perfect legal system to control alien species. But there are lots of questions in our current laws of preventing alien species from invasion, which have not fully included the relevant contents that invading species destroy biodiversity or ecological environment, still differing greatly with the goal of controlling alien species in terms of bio-diversity protection. On the basis of summarizing the national conditions about alien species of our country and under the guidance of legislative principle, our country should combine the existing legal provisions to setting up the legal system that prevent alien species from invading.“Legal Research on Invasion of Alien Species”is how to deaf with the alien species invasion problem that becomes more and more serious in our country from the angle of law. The researching purpose is by introducing and comparing the legislation cases of preventing and controlling the alien species invasion of international and foreign organizations to summarize some legislation experience which can be drawn on by our country, and by summarizing the basic cases and thinking over inadequacy of present preventing and controlling the alien species invasion in our country to put forward some useful legislation advice to offer some useful train of thought about strengthening the legislation in our country.There are four chapters in this essay. In the first chapter it talks about the basic concepts and basic cases of alien species invasion. In the second chapter we introduce and analyze the international and foreign legislation dynamic states concerning the alien species invasion. The last chapters are the main body of this essay and it thinks over the legislation of preventing and controlling the alien species invasion in our country.更多还原
