【摘要】 社会服务令制度从2001年首次适用之后,各地方法院纷纷进行了相关试点工作,但由于许多原因在去年该制度被最高院下文暂停。社会服务令该何去何从?被最高院暂停之后,是放弃原有的探索还是重整旗鼓从头再来?未来我国究竟应该构建怎样的社会服务令制度?这些都是摆在我们面前,不得不思考的问题。论文主要以我国曾试点的社会服务令制度为研究对象,分为五个主要部分:概念界定、国外或其他地区制度概况、我国制度研究、必要性可行性分析、未来模式展望。在第一部分“概念界定”中,主要对社会服务令的概念及相关基础理论进行研究,介绍了社会服务令目前各国适用的模式,并将之与相关的概念进行分析比较,如社会服务、社区矫正、保安处分、管制、劳动教养。第二部分,“国外及其他地区制度介绍”笔者就国外社会服务令制度的起源、发展进行介绍,由于香港与内地的人文环境有许多相似之处,其制度特别有借鉴意义。因此在这一部分特别介绍了我国香港地区社会服务令的具体内容及效果评价。第三部分“我国制度研究”笔者认为尽管社会服务令的概念是国外移植品,但其并非是一夜成名的“舶来品”,现代意义上的社会服务令在我国少年司法领域中的最终出现,其实也经历着一个逐步探索的过程。实际上这一制度的出现可归结为三个阶段。另外还就目前有关社会服务令制度的几种模式进行分析,指出我国目前的试点主要集中在检察系统和法院系统,混同吸收引进了国外的两类模式。第四部分,通过社会服务令推广的可行性分析,笔者认为,我们不应该让这样一个有着变革性意义的司法制度就这样暗淡下去,我国目前最缺乏的是相关立法支持、国家机关领导下的全国性的调研。笔者就自己掌握的有限资料从多个角度分析得出结论:社会服务令制度在少年司法领域内的创建十分必要,而且现在已经具备了全国推广试点的条件。第五部分“未来模式展望”,主要是将三年多的试点工作经验进行归纳,对试点过程中遇到的困难进行解答,对于以前社会服务令制度的完善提出相关建议,对未来服务令制度的设想进行逐一分析评价,提出立法建议。总之,本报告主要以研究社会服务令的起源、现状、发展为切入口,分析社会服务令几年来的适用情况,得出“社会服务令制度”的推广具有必要性、可行性的结论,最后重点总结法院社会服务令实施过程中的实践经验,探索社会服务令在我国少年司法制度中的前景,力图构建完善的社会服务令制度。更多还原

【Abstract】 Community service code was fist used in the year of 2001. After that, many regional courts put it into action, but because of many reasons it was suspended by the supreme court of China in the last year. What will be the future of it? After the injunctive, will it be come again after being researched or being given up? What kind of Community service code will be set up in china? These questions are all put in front of us, and we have to think it over.The article takes the community service code as research object that was used in our country. The article is made of six parts: defining the conception ,introducing pertinent system in other countries ,making experiences in China, researching about its necessity and feasibility , describing the mode of it in future.In the first part“defining the conception”, it mainly study the conception and relevant basic theories. It also describes a presentation of Community service code in other countries , and compares it with interrelated conceptions ,for example community service, rectification of community , public security sanction,public surveillance, reeducation through labour. In the second part“introducing pertinent system in other country,”the author introduce the code’s origin and development .Because of the similar cultural situation between Hongkong and the mainland, the system in Hongkong have important reference function for the mainland .In this article the author specially states specific content and effective evaluation of community service code. In the third part“making experiences in China”, the author contends though the conception of Community service code is translated from abroad , it’s not a exotic suddenly. Community sevice code in modern significance finally occurring underwent a exploration progress. In fact , we can conclude it to be three phases. The author also introduces the modes of the code, points out the experiments in china was mainly in procuratorate and judicial department. The code at present is mixed by the two modes. In the fourth part, after the feasibility research the author considers we shouldn’t abandon the revolutionary judiciary reform. In our country ,the important things are lack of the legislative support , the research being leaded by the supreme justice department .referring to the limited data , from mutil-angle prospective , the author make a conclusion that it is necessary to create the system of Community service code in juvenile justice field .And also points that we have the condition to extend it. In the fifth part,“describing the mode of it in future,”the author mainly concludes the experience in the action , answers the questions ,make suggestion about the improvement of community sevice code ,and brings forward proposals of legislation by analyzing the future community sevice code system one by one.In a word , the article is mainly concerned the research of origin, current situation and development of community sevice code. By analysing the practice in the recent years, the author makes conclusion that it is necessary and feasible to make the code popularized in the country. At last ,the author detailedly concludes the practical experience in the judicial department, explores the forecast of the community sevice code in our country juvenile justice, designs the improved community sevice code system.更多还原
