【摘要】 招投标作为最具竞争力的一种采购方式，正不断地深入到社会生活的各个方面，不但对宏观经济带来影响，而且正不断融入到微观个体的行为中。 工程招投标的实施促进了我国建筑市场的繁荣和经济的发展，节约了工程投资，提高了建设工程质量。然而我国实行工程招投标的时间还不长，国内的招投标业务还处于初级阶段，工程招投标中规范化的操作还远远不够，还存在许多腐败现象，工程招投标的管理亟待加强。 我国工程招投标中存在比较多腐败的原因可以归纳为两类：一是由于操作不规范，或者执法不严，甚至是知法犯法：二是现行的相关法律、法规不完善，评标机制、评标办法有待改进。本文引入信息经济学中的委托代理理论，指出防、反腐败就是如何减弱代理人的逆向选择和道德风险。工程招投标中的防、反腐败工作可从以上两方面展开。对第一类，重点讨论规范招投标各参与主体的行为，主要规范政府、业主、招投标代理机构、建筑企业的行为，建立相应的约束、规范机制。对第二类，提出从改进完善我国相应的法律、法规入手来防治腐败的发生，改进的方面包括：进一步完善我国的招标投标法，完善相应的配套法规；改进我国传统的招投标方法的不足；改进与我国国情相适应的招投标办法。实行无标底招标、建立新的投标企业评价模型、将模糊综合评判的思想运用到工程评标中。 通过十几年的实践，柳州市建设工程招投标已积累了相当的经验并形成了一套制度。通过剖析柳州市建设工程招投标过程中存在的问题，提出相应的应对措施。在柳州市某综合楼项目的实证研究，采取了本文提出的一些措施进行的，具有一定的可操作性，从项目实施情况来看是成功的。更多还原

【Abstract】 The tendering and bidding of engineering construction, as the most competitive means of purchasing, is continually getting down to all levels of the world, not only has impact on macroeconomy, but also molten into microcosmic individual behavior.Tendering and bidding for engineering construction, has greatly promoted prosperity of our country construction market and promoted economic expanding , and has greatly saved the investment of engineering construction, and it has greatly enhanced engineering construction quality.But the tour of tendering and bidding of engineering construction in our country is not long yet, internal tendering and bidding for engineering is still in the primary phase, and it is so far for the perfect operation on tendering and bidding, and there are still a lot of corruption phenomena, so it is necessary to enhance the supervise of tendering and bidding engineering construction.The reason why a lot of corruption phenomena exist in tendering and bidding can be classified two sorts. The first kind is such these reason: operation misbehaviour, or execute the law not tightly, even some people break the law deliberately. Another kind is: the actual rule and the law is not perfectly, and mechanism of bidding and way of bidding should be improved.The consignment-deputy theory of information economics is also introduced into this thesis. In terms of this aspect, it indicates that the corruption is the representation of the adverse selection and moral risks, and that to prevent corruption is to weaken the adverse selection and moral risks existing among agents.Based on the above analysis, in order to solve the first kind corruption the thesis put the focus on the ways to regulate the behavior the all parties involved in a tendering, it also更多还原
